I have just sat down to fill out my Adjustment of Status form after getting married last weekend and it is asking me to send in my fiance petition approval and affidavit of support form, both of these were in the sealed envelope that I handed to othe customs officer, which he kept.

Does anyone know what to do?

Affidavit of support form for K-1 is the I-134 and for AOS it is the I-864 so you will need to prepare new.

Why was your fiance petition approval form (NOA2) in your sealed envelope? It isn't a required document for a K-1 that I am aware of. If true, you have now learned a difficult lesson. NEVER provide original documents (particularly ones that cannot easily be replaced) with any of your immigration petitions/applications unless specifically required.

fwaguy is right about the affidavit of support form, should be current .

My only suggestion for the K1 Approval notice is to request a copy from the department of homeland security. In the future I would at least make copies of everything!

Good Luck to you !

You may be confused about the petition approval form being with the papers kept by the CBP officer. It would not have been in the sealed envelope. You received in in the mail. It's what we refer to as NOA2. If you lost it, you will need to get it replaced as others have mentioned.

Might it be possible, to just file an I-130 with AOS instead of paying to get the form replaced? As thats what a couple would need to do if they get married outside the 90 day limit or marry on another visa.

When I got to AOS I couldn't find my original NOA2 (no idea how that happened as I had thought I was being scrupulous about K1 record keeping). So I applied for a replacement NOA2 (and remember paying a large amount of money for it). They declined the petition for a copy as the approval was now out of date (well, yes of course it was as it's only valid for 6 months and it took 9 months for them to give me the visa). Anyway, I got no replacement and no refund of the money I sent.

So with my AOS application I sent the photocopy I had (thank God!) of the NOA2 and a copy of this documentation proving that I had tried to get a replacement of the original. I was never asked about it.
