Hi everyone,

So I am posting this question for a good friend of mine. I haven't been on VJ in quite sometime but I used to be completely addicted while I was working on getting my Belizean fiance to the states. I ended up moving to Belize at the same time I finally got my NOA2 and never ended up using it. While living in Belize I have befriended a nice American that is married to a lovely Belizean woman. They have two children...both have American passports but I'm pretty sure they were both originally born in Belize. I know one was for sure.

He filed the I-130 awhile back but he filed his I-129F this past January. He of course, like many of us, is feeling worried because it takes so long to get approved. I've told him that this a big waiting game and I'm sure everything is fine but he has questions and I thought, what better place than VJ to get the help for others going through the same process. Everyone here saved my life quite a few times.

I'm not sure of the exact crime but when he was younger something happend and he has a felony. He has told me that it has nothing to do with immigration law. Should this effect their chances at getting the I-129F or I-130 approval? I always thought that they didn't punish the American spouse in this way because they figure they are stuck with us as citizens as we were born in the sates. Does anyone disagree with this? He is very worried that this will play a role in the approval process. Also, he has the medical condition MS and can that play a part in helping the approval at a faster rate because he needs his wife to help him with the children full-time? I am aware that medical conditions are almost impossible at helping the approval rate speed up but I thought I'd ask. He has been living in Belize iwth his wife but will be returning to the states next week for medical reasons and would love to know if there is anything he can do once home to help his case.

Sorry, this is so long and I appreciate any help that can be offered. I know he is extremely appreciative as well. Thanks to all of you and I wish everyone here the best of luck.

P.S. I think his I-130 was done through the Chicago offices and his I-129F is with the Nebraska Service Center. When I was last around the NSC was the slowest.

I think of you so often--I hope all is going well out on the cayes and you're a boatin' fool!

The story has a few errors; hard to say if you've got terms mixed up or he does.

First off, if he's living there, he should've filed in BZ City (DCF). If he's not on a legal residency or they wouldn't take his case, he should've filed to his *Service Center* (I-130).

If he did send the I-130 to Chicago, that indicates a filing in the US for AOS.

I suspect there's some mix up in the story telling. Is he getting his mail in the US regularly? His I130 may have been transferred to CSC if he filed it an NSC.

He needs to supply some NOA dates for each petition so he can tell if he's outside of processing times or not.

On the criminal record, depending on what the conviction/charges were, it may be playing a part in a delay (if he is past normal processing). The USC's name is run through one name check for sure (IBIS) and a hit on the USC name can take awhile to clear while they investigate it.

HEY!!!!!!

I am so glad you replied to my post. How are you? Things in Caye Caulker are great! I'm actually sitting on one of my sailboats on the beach right now. I get luck enought to catch someone's wireless network every so often.

Your response is so right. I completely forgot all about DCF. I have to talk with him in more detail and get more of this straightened out. I'm not sure he did enough research when he started. I've just been out of the game for over a year and something about this island breeze makes you lose some brain cells.

The way I heard it is that USCs with felony warrents out on them were 'hit' by IBIS and located that way.

Recently I've heard of USCs being the snag during a 'name check' (don't know which one--they don't advertise them much) at the Service Centers (California comes up the most) and petition approval being delayed while the name check clears.

In other, more clear words, I have no idea if a criminal conviction will delay the petitioner, and I don't think anyone does know/can say with 100% certainty. I do NOT think it is a reason to deny a petition, based on an abundance of evidence posted in this group and others.

So, he obviously can't cancel anything he's got going on with the centers in America and try to do the DCF here in Belize...right? That seems like it would be major cheating.

Sounds to me like he missed a good opportunity with DCF and probably should have gotten on VJ in the beginning so he could have had his life saved like I did mine when I was just starting out.

No, it might still be possible to do, but he needs to know/communicate more about what his actual situation is. BZ is a small post, maybe they would accomodate him if he went downtown with a sad story, but he really needs to know where his other petitions are at first.

Call him to sit on the coconut next to you and bring his details ;)

He was supposed to meet me out here but his golf cart has yet to pass me by. So I will try to schedule sometime with him and get some better answers. I have been telling him to come onto VJ himself so maybe I can finally get him to do so.

You are right, it makes sense to notify the boarders if there is an open warrent.

Hi all,

I'm bringing this topic back up because I've found out some new information about my friend and I would love your opinions or any advice you may have.

Evidently his case never gave him any jail time whatsoever because he wasn't technically guilty. He had a crappy lawyer that had him claim "No contest" to his case but the judge never sent him to jail. He did however get 5 years probation and after completing his 3rd year they put him on a low risk status that didn't require him to go in office and report every month but he was supposed to be calling and checking in with them. He ended up moving before the last 2 years were up and now he is worried that he will have an outstanding warrant because of this.

This is been over 6 years ago and he was come back and forth between Belize and America dozens of times since then. He has never been stopped for anything. He's also even renewed his passport since then and didn't have any difficulty. If you have an outstanding warrant, would they renew your passport? I know someone that couldn't even renew their drivers license becasue of a warrant. So, he is going to the states this Tuesday and will check up on everything.

But he is very curious if any of you have heard about someone getting denied for their NOA2 on their I-130 or I-129F because of an outstanding warrant? Let me know what you guys think. Oh, I've also found out that he is with CSC.

but he was found guilty. When you plead no contest, that is the same as pleaing guilty. It only means that they cant use the fact againt in a civil lawsuit. He received probation.

I dont think it matters unles it was some kind of sex, stalking, abuse crime. It that case they will notify the spouse as a part of the process.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

no idea if he'd have an outstanding warrant (doesn't sound likely) but a criminal conviction of a USC petitioner should not be denied because of it. My hubby's got a record and conviction and all our stuff was approved ok.

He may have a hard time with proving support tho if he's disabled. Does he have a co-sponsor ready if needed?

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card
