I-130 and k3 fees

Hello everyone, I will going to the philipines now in mid Oct instead of Sept like I have mentioned in a couple of threads that I have left here in the past week. I will most likely going to marry this woman whom I have been in contact with for the past six months. I will be getting my final divorce on Sept 24, 2007. At least that is when the court date is. Had to plop down another $3000.00 for this after payment of the original divorce four years ago. for 2300.00. Boy lawyers, huh?

So my question is, if I get married over in the PI, providing everything goes all right, then I go back to the states and file the I-130 packet. What about the k3? I don't see a form for this one. Is this also a seperate fee? I have decided on the K3 since it seems the fastest way to get her over to the states. I have been reading the guides, but it is still a little confusing still.

Also, what about the filing for the I-485? Does this have to be done right away after she gets over here? That's a lot of money to shell out at one time. Like I have mentioned, I am not a righ man by no means. As a matter of fact this might be a obstacle for me for even getting her here. With back taxes owed and currently in a chapt 13, it doesn't look to good on my record. My anual income is around $50, 000 per yr.

For her to apply for a K3 visa, you'll need to file a I-129f petition and have it approved. There isn't a separate fee for the I-129f petition. It's filed with the I-130 petition and the $355 fee.

As pushbrk said in another post, your debt will not effect the immigration process. Also as pushbrk said in another post, you should think pretty hard about going for the K3 visa in your position. It may get her to the states faster but there's a chance it may not make much of a difference time wise, but it will certainly cost you more in the long run. It would also mean time lost when she could have been working if she wants to work in the US.

The I-485 doesn't have to be filed immediately. I personally wouldn't wait longer than a year after arriving.

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

From what you've told us about your situation, in my personal opinion, it would be best if you only filed the I-130. It may turn out that it caused the separation to be longer, but once she had the CR1 visa and came to the US as a permanent resident from the start, I don't think either of you would regret it then.
