hi im just wondering if i could do this. i filed for aos last july 28th and until now dont hear from uscis about it. not even an noa. so my husband and i are getting tired coz we arewaiting for the noa to file for my ead because we only file for aos last july. so now im wondering if we could just go on and file for ead without any noa of my aos. im a k3 visa holder. thanks in advance for the reply....

Hello Pinay (are you from India? :D ),

I applied for my AOS on July 19th and I just got my NOA today (more than a month later). Please be patient and hand in there. One of the reasons that you might have to wait a bit longer than usual is because you filed right before July 30th, when the USCIS application fees almost doubled. So a lot of people were applying at that time so that they won't have to pay the new fees. I don't think you can apply for EAD before getting your NOA or Appointment for Biometrics (sometimes, the appointment for Biometrics some first I got mine 3 weeks ago, and only got my NOA today like I told you). You'll need some kind of proof that the USCIS did receive your applications so I advise you to wait for either the NOA or the Biometrics appointment.

We did the EAD with AOS and wished we hadn't. Claudeth got her GC about two months after the EAD came so it was kind of a waste of money.

thanks for the reply. i wish i applied for ead first but we wasnt really thinking of applying ead before. but im really bored now and i need to help my husband financially so we was thinking of applying for ead tommorow but i dont know if i could since i applied for aos already but never heard anything from it. but i guess we will still tried to apply for ead in case they will deny it they will returned the fee anyway. we are not really sure yet what to do so im waiting for some more advises. Hi..what kind of payment did you sent? Money order or personal check? if it is personal check did you check your bank if they cashed the check already? When we sent my AOS application last June 26, we included my husband personal check for AOS fee and when they deposit it, we knew from there that they got our package.

As far as I know, you have to apply for EAD together with the AOS. I dont know with the case if you are applying for EAD after you applied for AOS. I have some friends of mine who applied for EAD and AOS and they got their greencard first before their EAD so for them, it was just a waste of money to applied for EAD.

10/09/2010: NOA1 Received via mail.

10/22/2010: Status Changed Online "Request for evidence" It was for Biometrics.

10/25/2010: Request for evidence recieved "Biometrics Notice".

11/18/2010: Biometrics date ==> 11:00AM. Biometrics was taken On time.

12/03/2010: "Yellow Letter" Received.

12/06/2010: "Touch" Case Moved to "Testing and Interview".

12/08/2010: Interview Letter received via mail.

01/13/2011: Interview Date. Done, " Thanks To ALLAH, I Passed the Test.

01/18/2011: Oath Letter was Sent.

01/20/2011: Oath Letter Recieved via mail.

01/28/2011: Oath Date. ==> Done, I am a U.S. Citizen

01/31/2011: Applied for a U.S. Passport Book, And, U.S. Passport Card.

02/25/2011: Passport Book's Received.

02/26/2011: Passport Card's Received.

02/28/2011: Certificate Of Naturalization's Returned.

we sent postal money order. but we are for sure they recieved our aos application on july 28th coz we send it with signature confirmation. yes it can be done applying ead after applying the aos but i just need the noa for it. im thinking my aos willl be approve late coz the greencard would be 10 years already since my husband and i been married for more than years already. i think we will just wait for noa then apply for ead. thanks to all your replies

For us the EAD was the best thing we could have done...

My husband applied for the EAD and AOS at the same time. His EAD was approved and he's been working for 2 weeks already...

On the other hand, the AOS is in limbo - hasn't even been touched for almost 3 months, or been transferred, or had an interview scheduled...nada...

I'm all for the EAD.

11/2004 - Met in Brazil

09/2006 - Apply for K1

03/2007 - K1 approved

04/2007 - Apply for AOS & EAD

07/2007 - EAD approved

01/2008 - Conditional Residency approved

11/2009 - Apply to remove conditions

02/2010 - Permanent Residency approved

11/2010 - Apply for Citizenship

03/2011 - Citizenship approved

07/2011 - Moved back to Brazil

yes i was thinking we could just apply for ead now. yeah we know we have to pay the new fee for ead but the aos is taking so long just to send the noa. our choice now is to wait for the noa then apply for ead. or else just wait until the whole aos is done. thank you all for the advises. God bless

You're a K3 holder right? You can apply for EAD without the AOS NOA. When approved, your EAD will be valid until the expiration date of your I-94.

You're a K3 holder right? You can apply for EAD without the AOS NOA. When approved, your EAD will be valid until the expiration date of your I-94.

hi misa, yes im a k3 visa holder. really i could apply for ead without the aos noa? i was thinking maybe they will reject it because i applied for aos already which until now i stil dont hear anything about it from the uscis. maybe we will try applying for ead wthot the noa. thanks for the reply...
