The thing is, there are laws in place that make people with certain backgrounds or experiences ineligible for visas. Most of those ineligibilities can be waived.

My comment was meant to be that each country has laws that are in place to protect the people of those countries and no-one should be embarrassed because of the laws of their country.

So if you believe the denial is incorrect, why not fight it with the help of a lawyer? If it is correct, why not submit a waiver?

As per my thinking the denial would be correct if the offence were more recent as in 5 or ten years given my age, this one (Mine) I find is well within the laws of the land but some leeway should be allowed for the fact that I spent 31 years with a clean record, pulled a stupid and paid for it then had another 31 years with a clean record.

Not submitting a waiver means never having the opportunity to live in the US. Ever.

I don't see how that is a bad thing, and I don't see it that way, living in the US is just a way for Sharon to be close to her parents. There are other countries that we would both love to spend time in. Our permanent address can be anywhere our little hearts desire.

Since you were pursuing a visa to live in the US, it's hard to grasp that it's not worth it to you.

Things change in life and even though I like the Dodge City area and the closeness to Colorado that we love visiting we don't have to live there to continue enjoying them. Her father is 87 years old and will not see 88 and he will not see his 69th wedding anniversary in October, his wife who is 96 will very likely not live much longer once he dies, these things happen to couples that have that many years together, one dies and the other just goes to sleep and doesn't wake up. With both parents gone there is nothing holding Sharon in Kansas or the US that a visit can't cure.

Again in the end it's your decision.

True it, and we are not rushing into something that may be for naught a few months down the road, we have 11 months before we have to file for the waiver, and that does not mean that we will be apart all the time I can find a place here for the two of us as we wait.

It's just hard to understand that you prefer to do nothing when you have options.

At this time we are doing what we think is best. You call it doing nothing we call it evaluating our options. If we were 30 or 40 we would most likely say what the h-ll and throw caution to the wind, but we are in our mid 60s and tend to think before jumping.

Ron I never meant that you had to justify your actions -- of course it's 100% up to you two and your individual circumstances. It's just hard to see it all happening.

My comment on the laws was more for joelunchbox and the idea of being embarrased to admit he's American -- I took that as basd on the fact that the US refuses visas for certain reasons (usually justified, maybe not in your case).

Kitkat1, Sorry, it was a very long and very tiring day.

The Waiver papers are a go! I am at this moment waiting for word from Sharon rergarding her putting in an offer for a house that She found and likes very much, should hear back about that in the next few days, I hope it is a go. Just got a call from the doctor about the alcohol tests and they are clean, doh, now I have to $100.00 for the doctor's letter, which I will get next week, That was the last thing needed for Montreal then the longest wait begins.

Hi Lona, Thanks, as for the question re: Sharon coming here, that would be a possiblity except yesterday we were told by the hospice nurse that is taking care of him that Sharon's father will be gone in the next few days. Once he has passed we have to try and move her mother to Dodge from Liberal because she is at this time becoming stressed over the coming death of her husband, and Sharon needs to return to work and the travelling would be too much for her.

You are one of the most giving people I've met in here Ron, and Sharon is going through so much sh!t as well, and you guys are hanging in there. I have no wise words, but a couple of intensively rude expletives for MTL for all this crapola. fOR FK'S sake, the car thing happened THIRTY YEARS AGO, and alcohol has not been an issue in your life for morethan 20 years - this is so insane.

Lona, Lenina and everyone else that has come here with support thank you each and everyone. You may not realize it but even the largest too the smallest coment even if it just a smilie face looking back at us from the screen it all makes the biggest difference to us because none of you had to comment or support us as you have. Most if not all that I write about our situation is not written seeking sympathy writing here and in a few other posts for me is downloading evrtying that could be bottled up inside making our present situation much more difficult to overcome.

One thing I miss which I was never too good at is posting in the Montreal forum, I go there and read and would like to add a few words but I am affraid to say anything because I don't know how it will come out and feel that what others have said is good and nice and I want that train of thought to continue.

Don't blame Montrel for what was done they were following the letters of the law regarding the auto theft and maybe the thing for the alcoholism, but you can get mad at Debbie for writing in my file what she did, that wasn't called for and proven to be wrong, it just cost $100.00 to get the test results from the doctor's office.

Life throws a lot of things at us and if we dwell on what happened, we wont see the good coming from it. Since the denial Sharon and I have found a house we like but may not be able to get it because according to some it is a re-fab (not accepetable) and other it was a kit house meaning that it built section by section and brought to the site and put together. We are looking at another as information on the first is sorted out. The house hunting was good for Sharon as it took her mind off the thought of her parents while she wasn't actually with them. All of what is going on is making us stronger in our committment to each other even if it is draining us of everything else.

Life indeed throws us all curves, and you and Sharon are strong in your love for each other, and have soul strength as well. You WILL succeed. In the US, in Canada, anywhere you go. The world NEEDS people like you both.

Remember it is a 2 way street. I have a little story about Canada myself.

Years and years ago my mom raised 3 children alone.

Not having a father figure around and a mom working all the time.

I got into all kinds of trouble. And I mean a LOT!

Anyway it snow balled into early adulthood. But by the Time I was 21 years old, I was out and growing up fast.

18 years later I planed a trip to Canada.

Driving accross the border they did a random check on me.

Called me into a little room in the back with a stack of old non violent charges and started to go thru each 1

all over again. Finally I reached over and put my hand on the papers to stop her.

I said, "You are refusing me entry right?" Yes was the reply.

I was told I could not return without a waiver from Canada.

I had been out of trouble over 18 years.

When you judge a country about its laws. Remember they are in place to protect us on both sides of the border.

I was shocked at first by Canada's action's.

When I met my wife I called and made sure it was ok for me to travel to the phil's before I wasted a ticket and was turned around

at the border.

By the way, None of this proved to be a issue in getting my wife's visa; which was just approved at interveiw 8/27/2007.

So keep the faith and remember;

There is no stopping a man that knows he is right and just KEEPS ON COMING!!!

Feb 6 notice they were moving the file to a faster service center.

Feb 26 Notice of I130 approval

Feb 28 2007 notice they were sending 129F to USCIS for further investigation (err #######?)

May 15 2007 notice of approval of 129F with processing dates of 05/15/2007 thru 09/14/2007

May 28 2007 Notice from attorney that NVC needed processed and money orders were needed.

June 4 2007 Traveled to Manila to spend 2 weeks with my wife!! (YeHaaaa!!)

Fed-xed her signed papers (For NVC) from Manila to attorney from Manila while on vacation

June 18 2007 Nvc approved support.

June 29 2007 packet arrived @ my home informing of interveiw for I130 on Aug 27 2007 and explaining Medical interveiw.

(Note wife never received packet for I130 in Philippines I fed-ex'ed mine to her for medical interveiw)

July 17 2007 packet arrived for 129F setting interveiw for Sept 5 2007

August 5 2007 Wife flew to Manila for medical interveiw on August 6.

August 26 wife flew to Manila for I130 interveiw on August 27 2007.

August 27 2007 12:31 pm I130 Approved

wife arriving Nov 18th

WIFE ARRIVED Nov 18th!!!!

hi Rick thanks for writing, We are keeping the faith as you say and we are as tight as ever if not more, We just have so many other issues in our face right now to keep our head screwed on straight.

I sure hope you're on the straight and narrow now with marriage a personal life style has to change since your living two live, yours and your wifes.

I have never been refused entry in the past, I can get into the States now, that is not a problem with a letter from Sharon's father's doctor and a return ticket plus the documentation from the consulate. The border people said that since the offence was over 31 years ago I would get approval from the person in charge.

Right now I am 63 years old and I was 31 when I offended and the offence took place 32 years and 1 month ago. If you read closer to the beginning you will see that I am in agreement with you regarding the law of the land and why it is there.

Rick, you are the American, your past convictions would have no consequence regarding bringing your wife to the States unless the charges were of abuse towards an ex or something like that. I am a Canadian and I need a waiver to go to the States and get married. If the charges were against your wife believe me she would today be waiting for a waiver and you would be waiting for her.

By the way, None of this proved to be a issue in getting my wife's visa; which was just approved at interveiw 8/27/2007.

hi Rick thanks for writing, We are keeping the faith as you say and we are as tight as ever if not more, We just have so many other issues in our face right now to keep our head screwed on straight.

I sure hope you're on the straight and narrow now with marriage a personal life style has to change since your living two live, yours and your wifes.

I have never been refused entry in the past, I can get into the States now, that is not a problem with a letter from Sharon's father's doctor and a return ticket plus the documentation from the consulate. The border people said that since the offence was over 31 years ago I would get approval from the person in charge.

Right now I am 63 years old and I was 31 when I offended and the offence took place 32 years and 1 month ago. If you read closer to the beginning you will see that I am in agreement with you regarding the law of the land and why it is there.

Rick, you are the American, your past convictions would have no consequence regarding bringing your wife to the States unless the charges were of abuse towards an ex or something like that. I am a Canadian and I need a waiver to go to the States and get married. If the charges were against your wife believe me she would today be waiting for a waiver and you would be waiting for her.

I fought for and won custoday of my son at birth and he is now 19 years old.

I dd that while obtaining a Electrical Engineering degree.

It has been 25 years since I have had any problems.

I do beleave they call that reformed.

As for my wife.

I have known her for over 3 years now. And have visited her in the phils 4 times.

She is the reason I breath. I am so lucky to have met her.

She was fully informed about everything long before we decided to marry.

I was just offering you the flip coin side of the story.

And yes I read your comments about the laws.

I agree with most the laws, and understand why they are in place.

Had I not just been going to Canada for a visit, I would have filed the waiver.

But only to visit, naaa no need.

Jan 10 2007 got receipt and case number!

Jan 12 2007 sent 129F

Feb 6 notice they were moving the file to a faster service center.

Feb 26 Notice of I130 approval

Feb 28 2007 notice they were sending 129F to USCIS for further investigation (err #######?)

May 15 2007 notice of approval of 129F with processing dates of 05/15/2007 thru 09/14/2007

May 28 2007 Notice from attorney that NVC needed processed and money orders were needed.

June 4 2007 Traveled to Manila to spend 2 weeks with my wife!! (YeHaaaa!!)

Fed-xed her signed papers (For NVC) from Manila to attorney from Manila while on vacation

June 18 2007 Nvc approved support.

June 29 2007 packet arrived @ my home informing of interveiw for I130 on Aug 27 2007 and explaining Medical interveiw.

(Note wife never received packet for I130 in Philippines I fed-ex'ed mine to her for medical interveiw)

July 17 2007 packet arrived for 129F setting interveiw for Sept 5 2007

August 5 2007 Wife flew to Manila for medical interveiw on August 6.

August 26 wife flew to Manila for I130 interveiw on August 27 2007.

August 27 2007 12:31 pm I130 Approved

wife arriving Nov 18th

WIFE ARRIVED Nov 18th!!!!
