How are they going to know how long they have been in the US? Wouldn't everyone just say over 5 yrs to stay?

Exactly.

Same thing I was thinking! If they are here ILLEGALY how does one prove how long they have been here? Who decides what is enough proof to prove how long someone has been here illegaly...Its not like there are any entry records.

Maybe they can show their pay stubs.....................

I don't know...I know a lot of guys who would be thankful for the chance to go home for a little while...and it's not like they really want to be illegal. I know a lot of them really would like a Visa.

And how long do you think is it going to take to process, say, 3 million visa at the US Consulates? Just trying to put your "little while" into some perspective. ;)

Rebecca, they are because there is no Visa option available. I know of one who came over on a Visitor Visa. He was very fortunate to get that Visa-it's not easy. You need assets, property, bank accounts-3 things a lot of Mexicans don't have. Aside from that, there was no "go to work for a couple years to make money and go home" Visa. So no matter what, there were no legal options. I'm telling you, some of these guys will put off going home to see sick parents, wives, growing children for years for fear of not being able to get back in and make the money.

Rebecca, you may not believe this but a lot of them do get pay stubs...in fact all of them I know.

I say "stubs" because that's all they get...the check is voided.

So? What about many other people who'd like that chance, but stayed home because they didn't want to sneak in illegally? You think every person on VJ who got a K-1 or a K-3 wanted to get married as soon as they did, or because there was no better legal way into the country?

Melissa, there is no such visa for citizens of other countries either. The only difference is geography and the ability to WALK - not swim or fly - across our border.

Save it for somebody with a few less brain cells.

I agree that it would seem difficult to impose these new regulations.

The point that has been raised already relating to how are they going to prove how long they've been in the country is they're here illegally is surely an obvious one? Duh..?!

And I know plenty of people from back home and other countries where people are less likely to make efforts to be here illegally who would love to come here and get some work experience while they travel, or straight when they get out from college just to experience another part of the world, but there seems to be no provision for nationals from anywhere other than Mexico to get a guest or temporary worker's permit. That almost seems to be discriminatory against those other people.

Personally, I have friends who are Mexicans and my husband is black so it's not about race or color, but I do think those same opportunities to qualify for a guest or temporary work permit should be extended to everyone who wants to make an application, not just a select few.

3 September 2004 INTERVIEW IN LONDON SUCCESSFUL VISA APPROVED! MARRIED OCTOBER 16, 2004

ADJUSTMENT OF STATUS - 5 MONTHS

4 January 2005 - Submitted applications for AOS and EAD - 12 May 2005 Conditional Permanent Residency Approved - interview in Santa Ana

4 June 2005 CPR 2-year Green Card arrives in mail

REMOVAL OF CONDITIONS - 3½ MONTHS

8 May 2007 - I-751 sent to CSC - 23 August 2007 - Approved - Card production ordered

30 August 2007 - 10 year Green Card received

K2 TIMELINE (Stayed behind in UK to finish school)

28 March 2005 - embassy interview & medical London - visa granted

01/18/06 Applications for AOS/EAD sent - 03/28/06 EAD approved

4/3/06 - RFE for AOS - requested new medical and vacc supplement

4/26/06 - approved without interview and welcome letter sent

05/02/2006 - Greencard arrives in mail

03/14/08 - Petition to Remove Conditions mailed to CSC delivered - 7/2/08 APPROVED

NATURALIZATION TIMELINE (for myself and son) 5 MONTHS

April 18, 2011 - N-400 Applications Mailed to AZ lockbox

April 21 (received April 25) NOAs

May 12 - FP Letters mailed

May 16 - Received FP appointment letters for June 8 at 11am

August 1 - Interview - approved for Oath Ceremony - OATH CEREMONY 28 SEPTEMBER

I never said he overstayed...as a matter of fact he hasn't. He went home for the holidays also.
