"The Neverending Story" - I-90/I-485 continues...

Well, maybe third time hasn’t or isn’t going to be a charm, unless this will seriously be the end of my saga. In any case, the I-90 is giving me more trouble and I feel like I should start my own chapter of “The Neverending Story.” On March 7th, basically a month ago, I sent off my 2nd I-90 package. I followed the Atlanta immigration officer’s instructions and started off a brand new package, which included form I-90, a letter explaining what was wrong with the card, a color photocopy of Green Card and passport, and 2 passport style photographs. As advised by the officer I did NOT include the original (faulty) Green Card.

Yesterday, April 5th, I received yet another RFE! Which I suppose I pretty much expected as I hadn’t sent in the original Green Card (as instructed by the officer). The RFE asked me to return the following within 30 days:

- The original Legal Permanent Resident card, along with supporting documentation (ok, totally accept that one)

- A detailed explanation of what the error on the card was (uhmmm, that was included in my I-90!)

- Two passport style photos (again, hello…did you even bother to check my letter??)

Once again the USCIS has managed to leave me speechless. I totally understand the original card. I was surprised when the officer told me not to send that along since the instructions specifically say to do so, but I was told to do it this way and followed the instructions. But what completely boggles my mind is that they asked for 2 more photos and the explanation of what was wrong with the card. I clearly included both of those in my I-90 package. I have already spent a good $35.00 on taking photographs for the Green Card alone (not even counting the numerous AP’s and EAD’s I’ve had to get them for as well), and now they’re asking me yet again to supply them more? (I thought they use the photos from the biometrics anyway?) I’m just getting really fed up with this. I know my resident status still counts, but getting this damn card corrected is causing me so much more stress and time and money that it’s really getting on my nerves. I want to say that I believe I’ve put in enough time that I shouldn’t have to put up with this much more #######. 25 months to get approved and now it’s already been another 4 months on battling with the correction of their silly mistake.

So I went to get more photos taken. I made yet another photocopy of my passport. I made an idiot-proof (or so I think – I guess you never know with these guys) letter explaining what is wrong with my card, included the RFE letter (making photocopies to keep for myself), and a cover letter showing all items included. I went to the post office and not only sent it certified mail like I usually do, but also added return receipt (aka “green card” – haha). So here we go again. I just hope this is the end. I suppose what annoys me in addition to all this is, even though I send in the I-90 I never receive the NOA for it. All I ever receive are the RFE’s, and they have the case number of my Green Card application. Of course when I go down to the Atlanta office, all they want to see if the NOA for the I-90 and tell me they can’t give me a one-year stamp with out it. Which is why I keep only getting the one month or three month stamps. I feel like I have less freedom with the Green Card than I did before I had it! At least my AP’s were always valid for a year. Now I always feel stressed in case I need to leave the country. This just…arrrrgh. Sorry people, I’m just frustrated, as always!

I actually also received a letter back from the congressman with an attached email that they received back from the USCIS. All it states is “we never received the photos, send them to such and such address.” So when I got my photos taken I went ahead and got 4 of them. Two of them I’ve obviously sent in to the I-90 RFE, the other two I will send to that congressman related address, which is different than the I-90 address. I’m just going to try to hit them up from as many sides as possible and hope ones comes through! Hubby and I booked our flights to Europe and are coming back July 17th. My I-551 stamp is valid until July 1st, so I hope my correct Green Card finally comes through in time for the trip. I guess otherwise it’s time for another Infopass Appointment. When will it end???

Thanks for all the support guys! I always appreciate your support when I'm frustrated and question how it can possibly get any worse and how I manage to still hang in there, you guys know how it is. :)

Your frustration is understandable, this is just positively ridiculous. Surely someone in that office has a shred of competency! To think you've waited over two years for the card and then it comes wrong, and corrections are messed up again....

There had better be one hell of a big bowl of cherries waiting at the end of this. ;)
