Hi Everyone, this is my first time post for the Forums. Hope anyone can answer the question.

I am a H1-B Visa Holder, and got married US Citizen in July.

Regarding apply a permanent resident card, I will submit all forms at once as below.

-I-130 Petition for Alien Relative

-I-485 Applocation to Adjust Status

-G-325A Biographic Information

-I-693 Medical Examination

-I-765 Application for Employment Authorization

-I-864 Affidavit of Support

My question is about supporting evidence for I-864, Affidavit of Support.

Fortunatally, my husband has income more than 125% of Poverty Line for three years, so I am thinking that just submit a photocopy of most recent Federal Tax Return Form, and most recent Paycheck stub as supporting evidence.

However, do We really need to submit a "Employment Letter" from my husband's employment? As long as I reserch this, got more confused.

Well, I have been working on these forms since 2 months, and to be honest, I am tired and alomost losing energy.

Could you anyone respond my question?

I know the feeling, seems like forever.

I am filing for my wife, and I exceed the 125% as well.

I am sending them the employment letter, I figure it is one less thing they can ask for later.

It is trouble I know, but you've spent 2 months, let your spouse spend time getting the letter :)

I know you are tired after 2 months, but remember there are many (most in fact) of us that deal with the government for a year or more, your pain will hopefully be over soon.

Hello! I think officially according to the rules, an employment letter is not really necessary if the tax forms prove the income. However, the more paperwork you give, the better it is. :yes: Personally I did not send an employment letter but I did include my job appointment paper, that they gave me when I was hired. Also, I sent in 6 months of pay stubs instead of just one.

I understand completely your feelings about all the endless paperwork. I thought that I was finished when I sent in the AOS forms but now I have to start getting everything ready all over again, for the interview. :wacko:

However all this work is towards permanent status in USA so it is worth it in the end! :thumbs:

I agree with this...

My hubby came in on a K1 visa so I was lucky enough to use the same employment letter that we had submitted previously. I exceed the 125% as well - but I figured CYA.

11/2004 - Met in Brazil

09/2006 - Apply for K1

03/2007 - K1 approved

04/2007 - Apply for AOS & EAD

07/2007 - EAD approved

01/2008 - Conditional Residency approved

11/2009 - Apply to remove conditions

02/2010 - Permanent Residency approved

11/2010 - Apply for Citizenship

03/2011 - Citizenship approved

07/2011 - Moved back to Brazil

I will ask my husband for Employment Letter, also enclose most recent tax return for three years, and six months pay stub. Hope an immigration officer would have enough patience for review all :whistle:

Just two more quesitons. Could you tell me what "ammo" and "CYA" mean?

Hello,

"Ammo" means as in ammunition in your battle to get through this process. "CYA" , means to Cover your ###. In essence--To have enough of required documents of which to satisfy the USCIS so that you are successfullin your Visa Journey.

My income is many times the requirement and has been for years. I submitted the tax returns for 3 years showing well above the requirement and yet, the adjudicator asked for an employment letter. I had an updated one with me, but I asked if it was really needed. He said he would not approve our case without it--so I gave it to him.
