K3 Interview / Passport requirement

Hi all,

My K3 interview is this week, and my passport is one month short of 1 year validity. It expires July 2008.

Do you think they would deny me a Visa due to this ?

10/23 - I129F - Transferred to VSC

11/01 - I129F - Package rec'd in VSC

11/04 - I129F - Touch

12/15 - I129F - APPROVED!!! WOOWWIEE!!!

01/05 - Rec'd packet from MTL consulate

08/25 - Medical Exam

08/29 - Interview at Montreal Consulate / K3 Approved

09/07 - Entered USA via Champlain, NY border. All is good.

CR1 Process

I-130

07/01/06 - I130 - Mailed to VSC

07/14/06 - I130 - Received NOA1 (I-797C)

14/12/06 - I130 - ****APPROVED **** WOOHOO!!!! / But Retained..boohoo...01/03 -

I-824 sent to INS for Transfer of I-130 to NVC

01/09 - 200$ check cashed. No confirmation in mail yet..

01/11 - Touch

01/13 - I-797 receipt received in mail...

01/31 - Touch

02/01 - Touch[/color]

07/31 - Approved I-824 / Sent to NVC

09/12 - Choice of Agent Rec'd and sent back to NVC

Not sure about Canada, but the New Delhi Embassy only requires the passport to have at least six months validity beyond the issuance date of the visa.

For a K3 visa interview, I'm not entirely certain they will put it in a passport with less than two years of validity because the visa is valid for two years. Upon entry, the I-94 is valid for two years also. I'm pretty sure they will do it, as long as the passport has six months validity but you would have been much wiser to have renewed your passport before now. Unless your green card gets issued before the passport expires, any re-entry to the US could be a bit complicated. At the very least, you would need to carry both the old and new passport.

Facts are cheap...knowing how to use them is precious...

For a K3 visa interview, I'm not entirely certain they will put it in a passport with less than two years of validity because the visa is valid for two years. I'm pretty sure they will do it, as long as the passport has six months validity but you would have been much wiser to have renewed your passport before now. Unless your green card gets issued before the passport expires, any re-entry to the US could be a bit complicated. At the very least, you would need to carry both the old and new passport.

For the US embassy in Montreal, they want a passport that is valid for at least one year. There has been a minimum 10 week or more backlog on passport renewals here, and they ask you not to renew unless it's an emergency. I'm short one month, so hopefully they will not deny me a Visa based on this.

Hope for the best. For clarity though, there is only one US Embassy in Canada. It's in Ottawa. Your interview is at the Consulate in Montreal.
