Hi. I could use some advice my husband received his packet from the I-129 process a couple weeks ago and is in the process of getting together all that it asks for to get his Visa interview. In the meantime our I-130 has been approved (yeah!) I understand from reading the IR-1/CR-1 guide that we could abandon the K-3 process and do the IR-1/CR-1 option so he may enter as a permanent resident....however, my wise friend who has previously done the immigration process says that we cannot do this as we have only been married since September. Is this the case? If we can do the IR-1/CR-1 process instead saving us the hassle of the adjustment of status process later on will this take longer to get him here because of switching from the K3 to the IR-1/CR-1? Just wanted to be sure before I take any steps as they embassy in Egypt can be very difficult! Thanks!

You can still do the CR1 visa. It will take longer to process but you will not have to AOS stateside. It will be a conditional 2 year greencard since you have not been married over 2 years. After his arrival into the states if he gets the CR1 he will have to LOC (Lift Conditions) and you start this process 90 days before the green card expires. Good luck on your decision and journey.

You have no timeline listed. If you are only waiting on K3 interview at this time you cannot file the CR1. You have waited too long. You can allow the CR1 to go to the embassy at the stage it finishes at NVC and inform them that you wish to pursue this one if you desire it.

Being you have no timeline is hard to tell where your I 130 is at this time.

We do not see your timeline. But you do not have to abandon K3..you have already paid for it..you might as well get the K3 visa....and wait for CR1.

My husbands Cr1 went quicker and we eventually abandoned the K3. It seems like that is rare though. Your friend is wrong, once he gets the Cr1 he can enter as a "conditional permanent resident". Expect it to take some time at NVC though. You can also just send in the I129f and see how it goes, if you dont mind the additional fee. I think that is what alot of people do. Eventually you will be able to weight your options (if it is more important to get him here quicker or get him here with the ability to work sooner).

Thanks so much for your reply...I didnt realize until you did that I could do both process's at the same time I thought I had to pick one or the other. I think I will give both a try and if it doesnt take that much longer it would be worth bringing him here under conditional permanent resident status. Do you know if he can use all the same stuff (doctor eval, police reports, etc.) for the IR-1 interview as the K-3 should he have to?

Can you get certified copies of those documents in Egypt? I don't know how it works there, but if it is like Nigeria it may be difficult. Since they generally request originals or certified copies you could use both. Yet since I dont know much about K-3, I may be totally wrong. Also keep in mind that someimes police certificates have a expiration date. My husbands were only good for 3 months, so by the time the interview came around he had to get new ones. I think his medical stuff also had an expiration date.

I suspect your friend is confusing the CR1 Visa to the IR1 Visa. If you decide to abandon the K-3 then more than likely he will be issued the CR1 visa, which means that in 2 years after he has arrived in the US you will both be interviewed again to prove the validity of your marriage. The IR1, and this is where I think he is confused, is issued the same as the CR1, but the difference is that when he enters the US if you have been married more than 2 years they will give him the IR1 visa. With this one you don't need to interview in 2 years...its a done deal. The next step is his citizenship.

I did both, & got the K3 since it came first.

Aug 18, 2005 - Mailed I-130 (wife & kids') to VSC

Aug 29, 2005 - NOA-1 for I-130's received

Sep 13, 2005 - I-130's approved, petition forwarded to NVC

Oct 10, 2005 - I-864 Bill received by agent

Oct 12, 2005 - Paid I-864 Bill by Postal Money Order-$70 for whole family

Dec 17, 2005- checklist for I-864 received, reply sent back & entered into system on Dec 22.

Oct 20, 2005 - Alien spouse received DS-3032 (Choice of Agent) documents

Oct 24,2005 - DS-3032 sent to NVC (fr Phils)

Nov 17, 2005 - IV Fee Bill paid by Money Order & sent

Jan 3, 2006 - Mailed DS-230 to NVC

Jan 4, 2006 - DS-230 entered into system

Jan 12, 2006 - CASE COMPLETED, and still waiting!!!

Aug 3, 2006- schedule of interview at US Embassy-Manila. Won't be showing up.

K3/K4

Aug 30, 2005 - Mailed I-129F to Chicago(wife's)

Sep 10, 2005 - NOA-1 for I-129F

Oct 19, 2005 - I-129F Approved (email notice), received mail Oct. 28

Nov 2, 2005- Received K3 approval notice

Apr 4, 2006 - Visas in hand

May 8, 2006 - arrived in America

August 2006 - mailed I-485 forms

September 2006 - Biometrics done

December 2006 - Interview; Green Card received by mail a week later

2007: Applied for kids' certificate of citizenship, got the certificates in June & passports in August 2007
