Son to Follow on K2 Visa

Hi to VJ Administrators, Members and Viewers!

I have a very important concern which I am not sure if I will be doing correctly.

My interview schedule is set on September. On my appointment letter, my name and my son's name are listed as travelling applicants. My son is to follow only after he finished his high school.

My question is:

1.) Will he still need to go with me for the interview?

2.) Will it be ok if I go for interview alone?

3.) Do I need to fill complete the DS forms for my son when he is not coming to interview with me?

I appreciate opinions in here.

I have learned that visa is valid for only a year. I decided to include my son on the I129F becoz I understand that it will really be very hard for me to petition my son once I am already in the U.S and make a separate petition for a relative. The plan is to make him follow only after he finished his high school in 2 yrs or so. When I filled up the DS FORMS, I indicated there that he is to follow, so I didnt pay for the embassy fee for my son.

Am I making the right move?

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

I agree it's easiest to bring him now or follow to join within a year. If it is important he stay in the home country for two years after his mother leaves, then the step-father can petition for a CR2 visa using an I-130. It's not a follow to join. It's an immigrant visa. The risk is that he marriage doesn't work out. Then there is a long separation or mom goes home.

Facts are cheap...knowing how to use them is precious...

2.) Will it be ok if I go for interview alone? yes

3.) Do I need to fill complete the DS forms for my son when he is not coming to interview with me?

the DS forms only need to be filled out for your son if he is applying for a visa.

The K-2 Visa must be ISSUED within one year from the date the K-1 is issued. once the K-2 has been issued, your son would have up to six months to enter the USA. if your plan is for your son to follow in two years, you will not be able to use K-2,

a I-130 petition will need to be filed for him.

Your son can follow to join but must receive the visa within 12 months of his mother. He then has six months to enter the US. If that isn't enough time, then you, the USC would need to file an I-130 petition for him after you marry his mother. As the USC step-parent, you can file the petition and have it approved with an immediate priority date. (meaning filing to visa is about a year) If his mother filed as an LPR, he would need to wait for a visa to become available. That's what was meant by waiting several years.

If you do decide to take advantage of the K-2 follow to join, remember to allow enough time to schedule an interview. Manila is a very busy Embassy for visa applications.

My wife son is follow to join also K-2, He didnt go with her in the interview but we was given year to pick him up., or file another petition for him. Once visa is issued that is valid for 6 months only.

Just a cautionary note: stepchild/stepparent relationship must be established before the child reaches 18 in order for the USC to be able to file an I-130.

Correct on this one, I did not realize it and we are waiting now for my Husbands GC so we can apply for his son that turned 18 1 month before we were married. So the wait is longer as he will be a child of an LPR and not USC.

Why is it that the only one who can stop the crying is the one who started it in the first place?
