Question regarding sponsoring brother-in-law

I will be moving back to the States, hopefully soon, and sponsoring my husband (Chilean citizen/Canadian PR) to the U.S. After his processing is complete, can we bring his little brother (my brother-in-law)? My brother-in-law was born in Canada and is a Canadian citizen and currently in high school. My husband's parents want to return to Chile (they are Canadian PRs as well) to retire. Is it possible to get a student visa for him to attend school and then process him for PR while he is in the U.S. on that visa?

I am not sure about this, but I think it is possible.... yet I'm sure someone else with more wisdom can give you more accurate info. Have you checked the USCIS website about this? Good resource.

He cannot petition for PR for his brother until after he is a USC and his brother is 21 years old or older.

His brother though can still come to the U.S. on a student visa. I think there are a few others here who have had student visas so hopefully someone will chime in.

ARGH... sorry, his brother doesn't have to be 21, but your husband does need to be a USC. Siblings of USCs are the last on the preference list though.

Seriously I'm not spamming your thread! I remember reading somewhere that Canadian citizens did not need a student visa (trying to find it again) but they did need the paperwork from their school. Interesting though since a friend mine did need a student visa when he was attending university in Chicago.

I don't have a time line yet to post. We haven't even started yet (no funds to start). I am trying to get a job in the States, then when I move and have some income, we will start the I-130. My husband is pending his Canadian citizenship processing anyway, so hopefully he will have that prior to the U.S. process getting very far along.
