I really think I might cry.

Best I can tell it is for stuff we already sent....but I will do it again.

Does anyone know if you have to re-submit forms with an RFE??

Like the I-864 affidavit of support...they are requesting that we send tax information in (we already have) to prove that I make above the pverty level.

I don't mind re-submiting my tax information. But now I am worried that I should get a co-sponser. This doesn't make sense to me because I make well above the poverty line and showed a years salary in savings.

Anyway..can anyone help? Do we need to resumbit forms or just send the information they request? And is it possible for them to send you another RFE on the same topic if you still haven't sent the correct information in? Or is that just a straight up denial??

My I-465 isn't in the system yet either, well not online at least. I have the NOA thought. Both I-130 & EAD are in. I think that the online system isn't very accurate lately, plus often you hear that people get letters when nothing happened online so I wouldn't worry about it if I were you.

With my I-864 I sent in 3 years worth of 1040's. all the schedules attached to the 1040's and the 1099's and I havent had any RFE's as yet.

What I will be RE sending is tax transcripts for the past three years. (directly again from the IRS) A letter on company letter head, hours worked, notable pay raises and possiblility for advancment, PLUS the last 6 months of payment stubs.

The payment stubs being the only new things added. In re-reading the RFE again it states I do meet the poverty line. Which I knew couldn't be a mistake. So as far as I can tell I will just re-send everything and add the payment stubs.

Of course there is room for a mistake on my part and maybe there was, but I was very careful to add everything they asked for and even the things that were optional.

Honestly I've been very very lucky to hit no snags so far. Hopefully this will be resolved in a timely matter! I just really wanted (like everyone else) to be immune from mistakes.

Submit evidence of the sponsors income. Evidence includes a letter of employment...salary, nature of the job...advancement... pay stubs etc. etc.

(9) is basically saying to send in my tax transcript for last year.

So either I messed up and sent no evidence, which doesn't make sense because my identical 2nd packet has all of those things in it...but anything is possible.

As I said when I first read the RFE I thought my salary didn't meet the 125% of the poverty line. But the very next sentance says it does but that I didn't submit evidence. Is that what you read as well?

No, that's not how I read it. Again, the devil is in the details. They are specifically asking for a letter of employment and pay stubs, not last year's tax transcript. You could sent the tax transcripts again but if you have some recent pay stubs, send copies of those too. Or maybe I'm just not understanding. Are you saying number 25 and number 9 are checked? If so, is there something in 25 you left out like perhaps the word "or"?

As for 9. Again, I'm trying to help you with details. What does nine say exactly?

It is looking more like some of your package got misplaced but without you being more forthcoming with details it is impossible to be very certain of that.

No, that's not how I read it. Again, the devil is in the details. They are specifically asking for a letter of employment and pay stubs, not last year's tax transcript. You could sent the tax transcripts again but if you have some recent pay stubs, send copies of those too. Or maybe I'm just not understanding. Are you saying number 25 and number 9 are checked? No there is nothing I left out in 25. As far as I can assume there is part of my packet missing. I must send evidence of my current status with my job. No problem I can do all that again. I have an interview for 11/20/07..can be added to the list! Also, I was never able to check my AP online- i had gotten an rfe for the payment,and when i sent that in,it took forever for them to cash,and then immediately i received the approved AP.So i haven't even bothered yet to put it in the system.I can check everything else though,but my I-130 hasn't been touched since i sent it!

Question: I'm not sure if i will use the AP,but if i were to..what are the risks involved?I wouldn't use it if i really have to worry about being let back in- and also,is there a limit as to how long you can leave for?

Since my husband is self employed I had to re do a I864 (instead of I864EZ)application and

submit more tax info and business letterhead blah blah blah....

I recent this info to the USCIS.

My online status was then marked "case resumed"

I assume they got what they needed!

Like the I-864 affidavit of support...they are requesting that we send tax information in (we already have) to prove that I make above the pverty level.

I don't mind re-submiting my tax information. But now I am worried that I should get a co-sponser. This doesn't make sense to me because I make well above the poverty line and showed a years salary in savings.

Anyway..can anyone help? Do we need to resumbit forms or just send the information they request? And is it possible for them to send you another RFE on the same topic if you still haven't sent the correct information in? Or is that just a straight up denial??

I've seen several people who had their tax information requested again. The only guess is that they might have lost some of the papers.

Send them all the tax info that you sent the first time, add things if necessary. If you are above the poverty level you have no reason to worry.

Included the tax return of the past 3 years, pay subs, a letter from your employer and yes refill the form, that way they can't say there is something missing.

Good luck, and don't worry, it's very common even if you sent everything.
