Just got online and got the noticed that USCIS has received our application today. Let the journey begin!

Ok, cancel that. I missed the post about the cutoff for the July filers being on the 25th. I'll just wait until August

Sarah08, when your NOA1 arrives and the actual NOTICE DATE is a July date, come on back to report and we'll gladly include you in our list.

Hi all,
I got some disturbing news in the mail today. We got a Request for Initial Evidence.....

When I filled out the I-864 Affidavit of Support, there was a Part 7 that said it was optional. It's for Use of assets to supplement income..... However, as I stated, is says it's optional, and it says "If your income, or the total income for you and your household, from line 24c exceeds the federal Poverty Guidelines for your household size, YOU ARE NOT REQUIRED to complete this Part. Skip to Part 8. "

I am significantly above the federal poverty guidelines, but we received this request to fill out part 7 and send it back in before they can process the I-485! This is an unnecessary hold up! I am waiting until Monday morning to call and find out why we received this. On top of all that, when I try to open the I 864P to confirm the poverty guidelines for a household of 3, I get an error message and my Internet Explorer closes.....

But, I am sure that I am above whatever the guideline is..... I am so pissed right now.

I guess I will get the same request for evidence then because I did not fill in the OPTIONAL page regarding assets either. Why the heck do they write OPTIONAL and say its not required if you are over the guidlines, but then send a notice that it's REQUIRED to process it. Sometimes I just wanna them in their little pea brains and say, "Haaallllerrrr!!!! Read your own dang form instructions!" Oh wait....its the freaking government! They can do stupid $(@# like that and get away with it. GRRRRRR

Woah! Calm down folks. Just because one person gets an RFE for this doesn't mean everyone else will. It is indeed OPTIONAL and there have been thousands of folks before you who've applied and have left that section blank and they didn't get any RFE.

If your income level is above 125% of the poverty level for your household size, then you should be OK. There is no need to worry about any RFEs. There may be something specific about LovinJA's case which prompted this RFE.

As long as your actual NOA1 NOTICE DATE is between July 1st and July 31st, you belong here with us. If your actual NOA1 NOTICE DATE is dated August 1st through August 31st, then you belong in the August Filer thread.

Didn't mean to cause a panic attack on the thread! But, I can't imagine why I would have to fill it out. I am over $50K, with a household of 3..... so, I can't wait to hear what they say when I call tomorrow. Anyway, just sharing info. about the process. I will keep you all updated.

I know - every day I go on, and say to myself, "TODAY'S the day," and every day I'm disappointed! :lol:

I'll give them until August 3. I think one month is enough time for them... !!

Our NOA1 date is July 3, and we're "not in the system".

well it is good to know that it ain't just me - let's hope that by Fri our 1 month anniversary that "we are in the system" I believe in realistic goals LOL but by Monday would be appreciated greatly!

Well I am not in a panic because there is nothing I can do if they ask for it except to provide the information. I just get irritated at stupid ####### like that.....something I did not include because it was allegedly optional. I suppose SirLance is correct in that each case is different, so we'll just have to see. It's just stupid that optional is not really optional and it created an unnecessary delay for at least one of us in a system that is already too lengthy and cumbersome.

Just my opinion.....

Most sponsors use income alone and do not include assets if they don't have to. So it really is optional. There is no "buts" about this being optional. For whatever reason, USCIS wants more financial info from LovinJA, but this is not going to be a general requirement for the rest of us. All of us certainly will NOT be getting RFEs because we didn't include assets on our I-864. Good luck to LovinJA with resolving their RFE.
