Need some help here on which visa?

Hi everyone, I am fairly new here and trying to weigh out my options on how to get my sweetheart over to the U.S.

I met her thru a friend at work and we have been talking every day for the past 5-6 months. Sometimes three times a day. I want to marry this woman. I am going over next month to get married to here, but this is all contingent on me getting my divorce finalized here. I have been divorced for the past 4 yrs except for the finalization. They have been taking child support payments out of my paychecks weekly. She has sole possession of our child and I have lived in alone. Now I want to move on with my life.

When I told my ex-wife about my intentions, she went ballistic! Tried to put a big guilt trip on me about what I am doing to my daughter, sending money over to this new woman in my life, ect...

I am not a rich man. I have expressed this before. But now with all the new fee increases it's going to get expensive quick so I am trying to find the cheapest way to get my new wife to be over here if that's possible.

I am seeing my lawyer Mon about the finalization. I don't know if it will be processed by Sept, so I might postphone it until Oct when I get everything in order here.

My plan was to get married and then start filing the 130 petition to have here come next year. But I am wondering if there is another way she can come over here right now on a temp visa and then work on the 130 petition? Man this is confusing. How much is this going to cost in the long run? Is there a link that gives a breakdown for what I want to do? So that would be the K3 visa and then eventually the 130. I can't find out how much the K3 visa is.

My biggest obstacle is that I am currently in a chapt 13 bankruptcy that I have been making payments for the past 3 yrs. My ex and myself have two more years to go on this. A large portion is going to back taxes. This doesn't look good. :unsure:

After the intial bankruptcy I accumilated some more taxes that need to be paid. So I am in dept with the IRS for around $15.000.00 right now. How hard do they look at your taxes? I work two jobs here n the S.F. bay area in Ca to make ends meet. Very expensive to live out here. But I manage. I make between the two jobs I work around $50.000 per yr.

This is a great site and plan on doing some more reading here about this but for right now it's putting a enormous strain on my brain to see how the process works. I need all the help I can get. :unsure:

The least expensive way to get your new wife to be to the US is with a CR1 visa. You get that by filing the I-130 only. Start by clicking on the word "Guides" at the top of any page. Please fill in your profile information. Good answers to your questions requires we know the country your wife will be coming from. K3 visas are faster but not necessarily the best choice. The cost overall is about $800 more and the immigrant doesn't have work authorization for a few months after entry. The CR1 takes somewhat longer but the immigrant arrives authorized to work. As a practical matter, they can work in about a month. (as soon as the SSN arrives)

You must be able to show proof you are divorced before you marry.

As far as your taxes, the returns (I suggest transcripts instead.) are used as evidence your gross income is above the 125% poverty line. Beyond that, your debts are not disclosed or examined. You alone must make the financial decisions. Obviously, $50k doesn't go as far in the SF Bay area as it does in many other places. Tough call on your part.

May 02, 2008 - visa in hand, had the CFO stamping done at once, bought ticket online...

May 03, 2008 - flew to US to be with stinky love...

July 22, 2008 - Sent AOS Package to CHICAGO Lockbox

July 24, 2008 - received package

July 29, 2008 - NOA for AOS and EAD

Aug 01, 2008 - Touched....

Oct 01, 2008 - Received EAD

still waiting on AOS
