This is driving me mad, and I've not even really started on the journey - lol :help:

I have been readin past posts and user SayWhat was bounced between London and the US !!!

For the first time in my life I'm watching my Credit Card and hoping that somebody takes $355 - lol

Our DCF Timeline

12/8/07 - Applied for Police Certs

14/8/07 - Police confirmed receipt

20/8/07 - Posted I-130 to London

25/8/07 - I-130 Returned asking for copy of Andrea's student visa and more proof that we live in the UK !!!

25/8/07 - Posted I-130 Back to Embassy In London (1st class recorded delivery) with copy of Student Visa and copy of Council Tax Bill

29/8/07 - Received E-mail (assume it is NOA1) confirming filing date of 29th Aug 2007 - YAY :)

30/8/07 - Money debited from our Credit Card

01/09/07 - The waiting begins :)

14/9/07 - Police Records Returned

1/11/07 - A company that interviewed me has offered the services of an immigration lawyer

7/11/07 - Immigration lawyer files my DS-230 and Notice of Readiness

8/11/07 - Embassy requests further information proving a viable marriage (if anybody hasn't yet filed their I-130, I would advise that you send the following with the I-130.

1) A affidavit from the petitioner detailing their relationship, how it started, developed, etc, etc

2) An affidavit from three people who know you both

3) Past emails, flight bookings, Pics, Dinner receipts, phone bills, etc, etc

12/11/07 - Send all the above back to Lawyer in London

26/11/07 - Lawyer got a case number and I have booked my Medical, I-130 STILL Not Approved

26/11/07 - Got the official offer letter from the US based company - YAY

27/11/07 - It official, the idiots at the USCIS have lost the RFE parcel - grrrrrrr

28/11/07 - RFE resubmitted

3/12/07 - I-130 APPROVED (NOA2)

4/12/07 - Medical

13/12/07 - Interview - APPROVED :)

29/12/07 - Arrived in Philli

AND Just as I Post this message, my wife forwards me an email from the embassy confirming receipt of the I-130 and confirming that it has been filed on the 29th Aug :dance::dance:

Can somebody tell me - is this e-mail the NOA1? (what does NOA stand for BTW?)

We have just had our I-130 returned today with the following letter

This office only accepts petitions from US citizens who reside in our district. US citizens whose principal residence is not in our jurisdiction, and/or who have entered the UK as a temporary visitor/student/or with limited leave to enter and remain in the UK must file the petition with the appropriate USCIS office in the US.

The UK Entry clearance stamp indicates that you have only been residing in the UK since November 2006, however, your biographic information (G-325A) suggests that you have been working and residing in the UK since August 2005.

If the latter is the case, please provide any other UK Entry Clearance stamps reflecting your status from August 2005

The 2nd and 3rd paragraph we are OK with and have supplied the appropriate student visa, however, the 1st paragraph worries us. I assumed you could DCF with an LLR, can somebody confirm this please.

What the heck? You've had LLR and lived in the UK since at least November 2006 and they were saying that wasn't good enough? That's not right. The new rule is six months on a resident visa (which definitely includes LLR).

What address did you use on the I-130? Your UK address? Did you include anything that proves you live in the UK such a council tax bill or copy of a lease/mortgage in the UK?

Hi there just come across your thread and was wondering because on the checklist for DCF London it says dont submit extaeneous documents ie bank/tax statements only submit what is requested. For my I130 application would it be unwise to go against this request and send extra info to prove my wife has been living and working in the Uk for the past year? Or would you send it anyway?

I would definitely send proof that your wife has been living in the UK. It certainly didn't cause any trouble for us when we submitted proof of living together and proof that I'd been living in the UK since 2005. In fact, I'm sure it's the reason everything went smoothly. We actually didn't even see the checklist or send things in the order they requested, and that was no trouble either. I wouldn't send an extra 100 pages of things, but I would definitely include copies of things that have both your names on them and something that shows when your wife entered the UK for the first time. No need to show that she's been working - just the copy of the visa that shows she's allowed to live and work in the UK. And copy any UK visas she may have had before (I sent a copy of the page with my UK student visa even though I'm currently using my LLR - it's just that it showed proof of when I first entered the UK).

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly
