Can I use my married name on the EAD application?

Hello,

When I came here on a tourist visa my now-husband surprised me with a ring and said let's get married. I applied for my AOS with my maiden name and already had my biometrics done. Now I am going to apply for my EAD this week and was wondering if I could use my last name or is it better to use my maiden, since that's what I used on my AOS application? Does it matter at all? Also, if I can use my married name, is a copy of my Marriage Certificate (as my supporting doc for the name change) enough to prove that I'm going to use my husband's name? I don't have anything else (SSN/Driver's License) under my married name.

I would stay consistent with whatever name you use with USCIS.

Why did you apply for your AOS in your maiden name? If you planned on using your married name legally after your marriage, you should have started using it immediately for everything after your marriage.

If you want to keep your maiden name, you are allowed to do that, but all of your identification should be in that same name, such as SSN, driver's licence, etc.

Consistency is the key. I applied for my DCF under my married name and the Consulate didn't say boo.- So from now on I'm Mrs. Nerd. Otherwise, you may need to provide them with an official change of name decree I would think.

Claudeth used her married name on both her AOS and EAD. She couldn't get her name changed on her social security card until she received something official from the USCIS with her married name. When her EAD came she was able to change her name.
