Is it possible to request an extension?

Hi,

My fiance has been accepted into a year long program in his home country to study which we think he should do, but we are worried since we are in the middle of the visa process. We would like to request an extension, is this possible? What do we need to do?

When does the year begin?

Since you don't have the NOA2, you could delay the interview for awhile once you do have it. Just delay sending Packet 3 back. (Be careful though to request that the Embassy extend your NOA2 since its only valid for 4 months) I've seen people do that successfully. Then once the Visa is granted its good for 6 months before you have to use it. That could buy you the year you're looking for.

I'm not sure if the Visa itself can be extended.

hi there

the above is correct..the only one that can request the extension is the U.S. citz...we had an extension done on our NOA2 for a month and my husband had to write a letter to the consulate in Sydney stating why we need the extension and for what date we were looking at having the interview...Robbie went to Ausralia to be with me at the interview that was the reason..

so include all your details Case number and date expires and the reason...give USCIS a call to see how long you can extend it for..but the 6 months after the interview is something to consider too..

12th Aug 2008 - Application received

14th Aug 2008 - Cheque cashed

18th Aug 2008 - Received NOA-dated the 12th

26th Aug 2008 - Received Biometrics letter

4th Sept 2008 - Biometrics-Detroit-Complete-'Touched'

5th Sept 2008 - 'Touched'

1st Dec 2008 - APPROVED-Card production ordered -112 days

8th Dec 2008 - USCIS mailed approval notice.

8th Dec 2008 - Received my 10 year Greencard in the mail. took 2 days.

Although I have the above date for approval my card actualy states the

2nd December..

His program starts this September and finishes in December 09. I am expecting the NOA2 anyday now, and I know that it is good for 4 months. So, if he plans on a December 09 interview and as I understand, he has 6 months to get to the States once he has the visa. This could buy on some time, however, we want to be able to travel back and forth between here and there to see each other, including up to 2 to 3 months before he would arrive for good.

So, we wouldn't want to request an interview until September or October of 09 so we can see each other during his summer break.

So, I think I do need to request an extension, but am a bit fuzzy on the details. Do I request it at the Embassy here? The Embassy there? A consulate?

oops - I mean the program ends in December 08, not 09.

Consular officers routinely extend the validity of petition approvals as long as they intend to approve the visa. I would simply wait until he receives the packet 3 from the Consulate, wait a month or so to send it back, with a request for a July interview date. Most Consulates will accomodate a selected month but few will honor a request for a specific date.

hi ya

if your going to be seeing each other before he moves here ..make sure it's before he receives the visa in his passport...because if he comes here (states) with a visa in there at the airport officals may look at it as him activating his K1 visa..(if you get me) and there is only time you can use that visa... but you would be ok to go visit him...

so just keep that in mind when visiting each other...better to be safe than sorry
