Hello All;

I am new to this board and am just beginning the process of applying for a K-1 visa for my Lady.

I have spent the last three weeks researching the process and paperwork necessary for the application

I believe I have almost all of the required documents, had some hand dilivered from Brazil last week by a returning friend.

My problem is reassuring my fiancee in Brazil that the process is ongoing and takes wuite some time.

She speaks virtually no English and I speak Portuguese enough for basic comunication.

I am looking for s web site that she can got to to have here questions answered by people who unnderstand her concerns and her language.

She is very frustrated and confused that i can get a visa to come see her in 2 weeks and it will take six months or more for her visa.

If anyone could help me out I would greatly appriciate it.

Have you taken a look at the embassies? Some have information posted in the language of that country.

Tentei montar um Step by Step, espero porder ajudar quem está no processo. Nossas colegas mais experientes certamente virão nos ajudar a melhorar/corrigir e/ou ajustar as informaçãoes aqui citadas.

Além do que, vale ressaltar que todas as informaçãoes aqui citadas são providas de minha experiência própria, pesquisas feitas na Internet e que é sempre bom checar junto ao Consulado se estão indo no caminho certo já que "de vez em sempre" alguma coisa muda ou novas aparecem!

Sugiro não postarem DÚVIDAS neste Tópico, o objetivo aqui é mostrar como proceder com o processo PASSO A PASSO. Existe um Tópico próprio para Dúvidas nesta Comunidade.

Vamos lá!!?!

1 - PETIÇÃO

Um dos pre requisitos para pedir o K1 é o casal ter se encontrado pelo menos UMA VEZ PESSOALMENTE nos últimos dois anos, portanto, tem de provar isso antes de qualquer coisa.

- Cheque Nominal à Imigração no valor de $455 (cheque o valor atualmente);

- 1 Foto tipo passaporte de cada um escrito o nome à lápis atrás;

- Cópia do Certificado de Nascimento do Norte Americano ou Passaporte que prove Naturalização ou Cidadania.

- Uma carta assumindo a intenção de se casarem no prazo maximo de 90 dias após a entrada nos EUA com o visto K1; (Letter of Intent)

- Uma carta relacionando todos os docs que estão enviando; (Cover Letter)

- Uma carta contando como se conheceram e os dois assinam, ou cada um faz a sua;

- Formulários: I129F (1 para o casal) e G325A (um para cada um);

- Provas do relacionamento: email's, cartas, cartões, FOTOS, se tiverem é bom terem provas do Noivado, bem como os Certificados das alianças ou anel, passagem aérea que prove que ja se encontraram pessoalmente ou que ele(a) veio ao Brasil, se tiverem, tb é bom terem provas de gastos em hotéis, restaurantes, ou seja, qq coisa que tenham feito Juntos.

Obs:

- Cópia da certidão de divórcio (ou de óbito) do casamento anterior (se necessário)

- Pra quem tem filhos: A única coisa que precisa na hora de enviar o pacote inicial, é incluir os nomes deles no formulário I-129F, quando perguntado.

* Documentos como certidão de nascimento, etc.. dos brasileiros (beneficiário e filhos) só têm que ser apresentados ao Consulado no dia da entrevista.

2 - NOA_1

O Peticionário (noivo(a) Americano(a) ) recebe uma Notificação pelo correio) de que sua Petição foi Recebida e está sendo Processada.

Neste momento O CHEQUE DE 170 dólares é descontado!

3 - NOA_2

O Peticionário (noivo(a) Americano(a) ) recebe uma Notificação de que sua Petição foi APROVADA ou lhe é Pedido correção de algum formulário que eventualmente tenha sido preenchido errado ou mais provas de Relacionamento que chamamos de RFE.

Ressaltando:

1) a Petição é Aprovada ou

2) o casal recebe um RFE.

4 - NVC

Quando Aprovado, seu caso é encaminhado ao NVC.

NVC PROCESSA E ENVIA O CASO PRO RIO:

NVC encaminha seu Processo para o Consulado do RJ. Todas as entrevistas de K1 do Brasil são realizadas no estado do Rio de Janeiro. Neste momento vc recebe por email seu RDJ Number = Numero do seu Processo no Rio de Janeiro.

Se vc quiser saber seu RDJ antes de receber a bendita cartinha deles "by snail mail"

O esqueminha é vc enviar um e-mail para o NVC para saber seu RDJ é o seguinte:

NVC e-mail: NVCInquiry@state.gov

Subject: WAC xxxxxxxxxxx (O número do seu NOA1)

Dear Sirs,

Since we were approved on October XXth and USCIS mailed our case to NVC, I'd like to know if it has arrived at NVC yet.

Case # from USCIS: WACxxxxxxxxxx

Application Type: I129F, PETITION FOR FIANCE(E)/K1

Petitioner name: NOme do noivo apaixonado - California/USA

Beneficiary Name: nome da noiva apaixonada -Rio de Janeiro/Brazil

Approval date: xx/xx/2006

5 - NOA3

Mais conhecido como Pack3!

O Requerente (ou seja, o noivo(a)brasileira recebe do Consulado uma Notificação de que seu processo esta no Rio de Janeiro e lhe é solicitado o seguinte:

- Cópia das 2 primeiras páginas do passaporte

- 1 foto tipo passaporte mostrando as orelhas (preferencialmente cabelo preso)

- Formulários:

DS 230 (somente parte I)

DS 2001

Envie numa folha em branco o nome do casal, seu RDJ Number e seu endereço para facilitar a busca do seu processo.

O objetivo do PACOTE 3 é saber se vc esta preparado para a Entrevista.

6 - NOA 4

Mais conhecido como Pack 4!

O Requerente (noivo(a) brasileira) recebe uma correspondencia em casa notificando A DATA DA SUA ENTREVISTA e os Documentos que vc deve providenciar para a entrevista!!

Ressaltando: Esses são os documentos que vocês deverão levar para a entrevista!

Alguns documentos precisam de cópia. Coloquem as cópias atrás dos originais. Não assinem nenhum formúlário, os mesmos deverão ser assinados na presença do cônsul. Levem todas as provas de relacionamento que tiverem ( fotos, cópia de passagem para os EUA ou Brasil, cartas, e-mails e etc.) Na maioria das vezes eles nem pedem para ver, mas na dúvida é melhor levar!!

1 - Passaporte (+ Copia das 2 primeiras paginas)

2 - 2 fotografias coloridas de frente(com o nome atrás) 5x7 ou 5x5 mostrando as orelhinhas!!! Preferencialmente cabelo preso!

3 - Form DS-156 (2 copias para cada requerente)

4 - Form DS-156K

5 - Form FS-257a

6 - Form DS-157

7 - Form I-134 (Affidavit or Suport) Suporte financeiro e evidencias

- Últimos impostos de Renda do noivo(a)

- Carta de que tem emprego fixo

- Carta do banco (não é obrigatório)

8 - Certidão de nascimento e copia

9 - Sentença de divorcio de casamento anterior (se aplicável)

10 - Atestado de bons antecedentes e copia (secretaria de segurança publica e Policia Federal)

11 - Certificado de Reservista (se aplicável)

12 - Traduções de documentos, se não estiverem em inglês ou português

13 - Recibo do Citibank de US$ 100.00 para cada requerente

14 - Exame medico (lacrado)

Atualize sua carteira de vacina! se vc perdeu a de infancia, providencie uma Nova no posto de saude mais proximo de sua casa.

Pergunte ao médico que vc pretende agendar sua consulta, quais vacinas vc deve tomar para atualizar sua carteira. Cada médico pede uma coisa, é bom vc perguntar antes!

Aproveite para perguntar ao médico que pretende passar, quais exames ele vai querer, se vc puder já ir adiantando, é uma boa!

A maioria dos médicos pedem apenas exame de sangue e chapa do pulmão.

Pergunte tb se ele aceita que vc já leve os exames, assim vc pode fazer usando seu convenio, caso tenha! Alguns médicos não aceitam.

Mas se vc tem convenio e ele aceita, ótimo! vc economiza!

Se vc quer agilizar seu processo, procure saber QUANDO seu caso chegou no Rio!! Quando tiver certeza que seu caso está lá, nao espere receber o PACK3 em casa, mande-o imediatamente!

PACK3 = Doc's solicitados no Pack 3 citados a cima!

Pra saber se o seu caso já está no Rio, ligue! sim, ligue todos os dias perguntando! (mandar email demora uma semana p responderem e respondem Nao p tudo! rssss)

Consulado do Rio de Janeiro: (21) 3823 2021, eles só atendem das 13:30 as 15:30. Vc vai ter que esperar um pouco prá ser atendida, a dica é ligar lá prás 15:20/15:25 que vc vai esperar bem menos.
