RFE :they want me to send the death caertificate and divorce decree

Timeline

Today i got email that they want me to send the death certificate and divorce decree for my previous marriages.... when will the opportunity to send those documents expire??? :help::help:

My K3 petition was returned back to USCIS on Jan,22nd,2008 and i am still waiting till this moment to hear from the USCIS

I don't think it does expire as such providing you keep them advised of what is happening.

If it is going to take some time to obtain the documents, reply to the request stating it has been received and the expected time frame to comply. Keep them appraised of progress so they realise you are dealing with it not just given up.

You will only have problems if it takes a long time and you haven't let them know you are dealing with it and your application is current.

I understand it doesn't expire (though petitions have to be completed within a time frame, so I may be wrong). But your case will not continue processing until they receive (and acknowledge receipt) of the documents.

The RFE that you get in the mail wil have a date by which you must submit the required docs. If they do not receive what they requested, it will state that wil will adjudicate the petition based upon the information that they have.

This will certainly mean that it will be denied since you have not proved that you are free to marry.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

I was RFE'd for some documents early in the process, and the letter did not indicate a specific date: it just said something to the effect of: "this consular post needs more information to continue processing your application". But that's Montreal, I don't know about other posts, it could be different.

Desertfox is right though: you need to prove your previous marriages ended one way or another, or you are immediately ineligible for a marriage-tied visa.

To the OP: what I do know is that if you don't send what they ask for, you are left in limbo, and it's a tough one to catch up later, so hurry in the document hunt!!!!

I received an RFE from the USCIS center adjudicating my original petition. It defintely had a cut-off date for receiving the info, or that they would adjudicate the petition based upon the info that they had in their possession.

It also had a return envelope which had a special address just for RFE's so that the info gets back to the Adjudicators desk in a timely manner.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.
