Here's my question... I'm sure this has been answered here somewhere, but I can't find this info.

Me and my wife were just married on March 15th. We just received our marraige cert in the mail, so we can now start filing. She is here with me in the US on a student visa which expires in July of 2006. I am trying to get the I-130 together with all of the supporting docs, but I can't seem to find anything that tells me if I need certified copies of several required docs or just photo copies. Can someone tell me what is acceptable based on the doc I've identified below? Thanks so much in advance for any help you can offer.. :)

1) My original divorce decree

2) Her birth certificate

Unless the instructions state that an original is required, you should submit photocopies of all required documents, including your marriage certificate, and the 2 documents that you reference in your post.

You should take originals plus a copy of each to the interview. If the USCIS wants to see an original before the interview they will send you an RFE asking for it.

If you mistakenly send them an original document in your initial submission, don't bet on getting it back. They do state clearly that if you do this, they will keep it.

Copies of everything should be good enough. I found the VJ-checklist helpful in assembling my I-130 package. You can find it here.

If she is here on a student visa and you just married here maybe you can look into AOS now. There have have been other posts on this issue and I seem to recall that others have done the AOS successfully. If push comes to shove go see an immigration attorney.

If her birth certificate is not in English I would ubmit translation, it is written in instructions that you need one.

I also heard you can translate it yourself and say at the end of the document that you have translated it to the best of your knowledge, sign your name and notarize; but I don't know it for sure. I got mine translated at the embassy.
