K3 over i130

Timeline

I have read here in several k3 subjects that if the i130 is approved prior to the k3 they automatically abandon the k3. With me the k3 is my only choice with a child involved since I did not send a seperate i130 form for the child. What if you do not want them to abandon the k3? Can you call and request that is doesnt get thrown out?

Met in Medellin Colombia October 06

Was in Medellin 1 week every month for the the year

Married June 28th 07 Wedding in Bello ( applied for residence in Colombia, granted temporal residencia for 2 years.)

07/07/07 Sent i-130

07/17/07 NOA1

03/24/08 Touched

03/24/08 Called

04/17/08 Touched

04/23/08 Called again

05/14/08 Approved Email notification

08/14/07 I129f sent

09/20/07 NOA1

05/14/08 Approved Email notification

Need the i129 approval

Hello. :) It's the opposite actually - well, not that the I-130 is abandoned, but it's put on hold. You have nothing to worry about in regards to that if you want the K3. If the I-130 is approved first, the I-129f for the K3 will still keep going. If the I-129f is approved and forwarded to NVC, then the I-130 is put on hold.

US Immigration Timeline

-------------------------

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

For the K-4 to adjust status you will need an approved I-130... so you may want to prepare accordingly....

For the K-4 to adjust status you will need an approved I-130... so you may want to prepare accordingly....

Thank you for your comments, always very helpful. As far as getting an approved i130 for the child for the aos can that i130 be done here in the local immigration office or does it have to go through the same process in the CSC?

Nope, no local adjudication of petitions. You can file the I-130 now or wait and file it concurrently with the status adjustment. Before July 30 would have been the really smart time to file the I-130.
