Thank you so much for your sweet comments. I am still having a lot of neck pain and a terrible headache. The insurance adjuster called and he said my car is a total loss. He said his supervisor has to see it also before they can pay off the car and he cant come until Tuesday. We still have the rental car. I do not like it. It is a chevy HHR. I would not have one of those, but the young people seem to think it is cool. The motorcycle driver is ok. He has a broke leg or foot, bruised chest and a concussion. He is at home now. He also did not have a license or insurance. Both the driver of the car and the motorcycle got ticketed. Someone told me, it is a 1000 dollar fine if you dont have insurance. Would have been cheaper to just get the insurance. I havent heard anything about the driver of the car. It wasnt even his car.

Can you persue the owner of the car? In my state you can. Owner's insurance is actually primary before the driver's in a case like yours. The most important thing is that YOU and your honey are ok. I hope you are able to get some type of restitution. Might want to check with an atty in your area.
