Quick question:

I filed for an extension for taxes for 2006 and have not filed taxes yet. I have until Sept 15 to do this. I am ready to do the I-864 now. Can I file the I-864 using my 2005 taxes? I think that I read that they base approval on the last year filed, and technically I am not obligate to file for 2006 unitl sept 15. Any thoughts or ideas would be appreciated

You may not be obligated to file to IRS but USCIS wants to see the tax returns from the most "recent" tax year.

Not the last year you filed.

Be expecting a RFE if you use 2005.

Sept 15 isn't that far away.
