Timeline

Thanks KitKat! That's really great information. You can bet I will be researching my ### off in the next week.

Feb 21, 2007: Mailed I-129F via USPS Priority Mail.

Feb 24, 2007: I-129F arrived at VSC at 3:01 p.m.

Feb 27, 2007: NOA1

Feb 28, 2007: They cashed my check.

Mar 2, 2007: Touched! I'm guessing this was my check clearing :)

Mar 5, 2007: NOA1 arrived via snail mail.

Mar 15, 2007: NOA2!!!!!!

Mar 21, 2007: Petition sent to Bogota

May: We send Packet 3 by fax; fax never received.

June: We send packet 3 again; it's sent back because my fiance didn't write NONE and N/A.

July: We send packet 3 again . . .

July 23rd: We get an email from the embassy. Our interview is August 21st!!!

Could one of the moderators put this in the guidelines or something to help people that may qualify for a waiver?

There is already information pinned at the top of the waiver forum. The link I posted is freely available online although the VJ admin refuses to allow the link to be fully posted here. The information cannot be copied and posted here as a pinned document. Really, VJ is not the place to find much waiver information and there are several other sites much more dedicated to waivers - that's why I included them in my signature.

So i guess i have the same case about overstaying here, i was overstayed my visa for 2 years and i'm about to have the K-1 visa interview next month, i know i'll get denied but i also definitely don't want my fiance to apply for the waiver, i'd rather wait until 10 years with him go back and forth than he has to file for the extreme hardship and relocate permanently to my country. That would be unfair. he wouldn't mind with moving in to my country but i will never say yes because its not only about us but about his family too. Hey 10 years isn't too long, is it? i must be crazy say that isn't too long huh:), but someday when you already passed that 10 years, you would look back and smile at it and that would be the thing that will strengthen your love bond with your loved one. Thanks a lot tho for alllll the information, specially for Kitkats, you the best at the info, thanks a bunch!!!!

Dec 2007 - K-1 Visa Interview (denied), the reason: i was overstayed my previous visit in 2000-2003 (my bad)

Feb 2008 - I-601 Waiver filed

Sept 2008 - Waiver approved (K-1 Visa issued)

Jan 2009 - the Wedding Blessing & Reception (Bali, Indonesia)

Feb 2009 - Arrived in the US followed by the Civil Wedding & Reception (again:)

March 2009 - AOS filed

April 2009 - Biometric

May 2009 - EAD card in hand

Aug 27th 2009 - AOS Interview (approved, yaay)

Sept 2009- Green Card arrived in the mail...yippeeeew...(i want to sing of Your Love forever)

June 2011 - ROC filed

July 2011 - Biometric

Dec 2011 - ROC approved (Best Christmas ever, i must've been a really good girl this year :)

The wait would be unbearable but it'll be worth it. It strengthens the love, it attaches you even more to each other, it shows how your man would do whatever it takes to be with you, that he will never give up on you because he LOVES you!! All the waits, stresses, tears, heartaches, all the miserable feelings you feel along the way will be paid off once you get what you've been hoping for...oh and WITHOUT PRAYERS? will be like trying to start a fire with water, JUST WON'T WORK!

??? You would RATHER skip the waiver and spend the next ten years apart? The waiver does NOT mean he has to move -- an approved waiver means he WON'T HAVE TO MOVE. It means your overstay is forgiven and you will get your visa (assuming the waiver is approved).

Are you confused or am I confused about what you wrote?

hello, yeah maybe i was a little confused with that EXTREME HARDSHIP thing. What i know about that is my fiance (US citizen) will need to move permanently to my country if the waiver has been approved, but i think i was totally wrong. So He won't have to move at all if the waiver approved? So can i get more information about this extreme hardship so i can understand clearly, thank you!!!

The whole point of the waiver is to WAIVE the ineligibility so a visa can be issued to the applicant - meaning the foreign fiance GETS a visa and the USC DOES NOT have to move.
