NVC doesn't like my I-864 income

I already posted this in the Canada forum, but haven't received a reply so I hope someone out there might be able to shed some light?

So I just called NVC and listened to the recorded message:

On August 20th we mailed you a letter as we found information missing or incomplete on your financial evidence - mailed a checklist letter on august 20th for correction, please return this information to the NVC in Portsmouth New Hampshire.

Sooo I call and speak with someone and she says we have missed question 15 - Country of Domicile and they say my income for 2004, 2005 and 2006 does not match my U.S. tax return (I entered zero for all three years). I have tax transcripts, can anyone shed some light on which line or figure they are looking for? She said adjusted gross income - (I have only foreign income for the three years btw - which I included in my tax return but the net result was of course zero because of the foreign tax credit).

Also, she said we failed to answer question 15 - country of domicile. I actually don't think we failed to answer, I think we left in the wrong answer!

I had decided to answer U.S. and sent documentation to support it. In looking at the copy of the form I have, it looks like I left Canada in there - oops. At least I hope that is all they want - I hope they aren't requesting further proof of domicile.

So I hope someone here will have an answer to the tax question, from the little info I could find by doing a search I think perhaps I should have stated my Canadian income converted to U.S. dollars?

I suggest you wait until you get the RFE and see what it says. Info operators don't always [not even close sometimes] get things correct!

Yes you are right, I actually just started another topic on this, I think NVC is now getting many of these types of applications and it's going to be a hassle.

I confirmed on a second call that they have decided I have not provided enough info re domicile.

In fact the person I was speaking to said "why did you file this with us" and her supervisor told her to tell me to send in my Canadian tax returns - oh dear oh my.

Actually - to give the details, they have an issue with both.

They want more proof of domicile (this will be tough as I have never lived in the U.S. - however I will prove it somehow - basically we just need to prove intent)

The second thing was, I filed taxes for 04/05 and 06. My adjusted gross income for all 3 years is zero. As I did not exceed the cutoff, by using the 2555-EZ. In other words I had Canadian income but for IRS purposes my adjusted gross income is zero.

She said to me, your income can't be zero on that line, I said oh but it is and I explained why.

When we ended the call - she was very nice, I said thank you and she kind of laughed and said 'I hope I gave you the right information'.

I'm laughing right now just thinking about that conversation.

Trailmix: So, what was decided in the end? For reporting your 2006/2005/2004 gross income, are you supposed to put $0? or your real income from Canada? thanks.

It is frustrating and confusing. If you follow the exact instructions on the I-864, her income should have been $0 but then it often turns out to be a problem and seems they're actually expecting to see foreign income in dollars. My hubby's interview is Monday in London and we're going to bring two versions of my I-864 - one with $0 as I only have foreign income, and one with my foreign income listed in USD. But those going through NVC instead of doing DCF don't have that luxury.

I thought the rule was that you can not use your foreign income to meet financial requirements, unless this income will continue after you move to the US?

You may have to find a co-sponsor, or to show that you have assets in the triple the amount you need for 3 years, or to get a notarized job offer from the US... at least this is all I can think about right now :unsure:

I mean I know all this should not apply to you, as you should have been able to DCF :angry: ,

but now this is where beaurocracy leaves you...

Yep, it's true that foreign income that won't continue after the move doesn't count. I am sure trailmix has either assets or a joint sponsor. The problem is just with the form itself. The instructions say to put your gross adjusted income, which is $0 for people who exclude all their foreign income and don't have US income, but now trailmix is being told she should have put her foreign income in dollars.

I actually answered your question in your other post Toshiya, however just wanted to mention that Margot is absolutely correct in describing what they (NVC) requested I enter on the I-864 and how the form is unclear.

I have also seen people post that they did enter zero and it was accepted - so I personally think it is safer to state the foreign income in U.S. dollars.

Not only did they want me to state my total income (before allowing the deduction for the foreign tax credit - which brought my total 1040 earnings to zero) I also had to send them a copy of my Canadian tax return. Go figure.

I remember that the guy who prepared B's late tax returns for our DCF did 'translate' his Canadian income into USD... don't know how he did it (what exchange rate and what's what). Country of domicile was US (attaching a "he's a foreign student in Canada" letter).
