Ok, so about 18-19 years ago (yes, looonggg ago) my husband (intending immigrant) had some charges brought up against him. He was aquitted (sp?) of several (things like fighting and such). But he was convicted of 2. One was issuing death threats (he said he would shove a beer bottle up someone's 'you know'...they considered that a death threat). He got 1 year probation for that. The other was that he ripped a public sign off a fence or something. He was convicted but was told if he paid for the sign, it would be let go. So, I'm not even sure if that will show up or not.

We just got his fingerprints done and sent them off to have the criminal check done.

When the record comes back, will it be sealed or can we see what's on it? We have to get court records for those convictions and he's not sure of the dates or places and I figure they will be on that report. He's also not sure of that one and know that will be there too.

As far as court records, are they just for the convictions or does he need Certificate of Aquital (sp?) too?

And will it be a problem with that one threat? When I called the court to get the records from them, she acted surprised that he wasn't applying for a pardon. Should he have? Or will it be ok since it was so long ago (he was around 18 at the time)?

2-26-2008 heard back from Montreal via email about our interview date

4-23-2008 Montreal Interview!!! Visa APPROVED!!

5-31-2008 Crossed the border into the US to live! :) (one of the happiest days!!)

Currently residing in NC and loving it!

03/2011 Looking into getting dh US citizenship (and just when I thought we were done with all the paperwork! Ha!

3-18-2011 Paperwork/check sent

3-25-2011 Check cashed

3-25-2011 NOA

4-16-2011 Fingerprints

6-15-2011 Interview

7-02-2011 Oath Ceremony We're done!!

well, I don't think that something like that will affect the visa process. Yes, the instructions are clear, he needs to report everything. The police report will not be sealed and from it you will be able to get the necessary court documents. Even if he has been pardoned he still has to report what happened.

Maybe other members will have a different idea on how bad that life threats can be...
