Despite my efforts to stop it (see timeline below), I have just learned from the State Department's visa information line that our K3 application is now at Frankfurt and that they have already sent the Package 3 instructions to my wife. Now what? At this stage we do no longer want the K3 since the IR1 is completed at the NVC and about to be shipped to Frankfurt later this week as well. Any advice how to handle this situation would be much appreciated.

Specifically, should my wife simply not respond to the package 3 and wait for the IR1? Or should she respond that she's ready for the interview, expecting that the K3 interview date set forth will then be taken as the IR1 date once the IR1 case is at Frankfurt? The latter course of action, of course, would be preferable since presumably it would give us an interview date sooner than waiting for the IR1. It's drawback, however, is that in responding to the package 3 one must check off as to having certain documents ready. The crucial document here is the I-134 Affidavit of Support that we haven't prepared since I submitted an I-864 with the IR1 to the NVC instead. Is that going to be a problem if my wife checks off being in possession of the I-134 and then pointing to the I-864 in the files at the time of the interview?

Any thoughts, anyone?

Thanks.

No biggy shooting her a I-134. Sounds like you have plenty of time.

If the K3 interview pops up first. Have her take it and do the IR-1 later.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!

Have you called the NVC to find out when they'll be forwarding the I-130 to Frankfurt? She can then call the embassy to find out what interview they should be scheduling for. Either way, she can ask to be interviewed for the IR1 instead of the K3 since you're all done with the process with the NVC.

Yes, Diana, of course, but -- as usual -- I only got the standard "two to three weeks" answer since they are not supposed to make predictions. The operator (who was very friendly) added, however, that I should check back next week, leading me to believe that it'll be shipped later this week. (I know ... hope springs eternally...)

I guess I'll do what beckypua suggests and prepare an I-134 just to be on the safe side of all formalities. Since I'll be with my wife in Germany at the end of next week anyway, I can take it with me. I won't have some of the original supporting documents (they are with the I-864), only copies, but so be it.

Just an update:

The IR1 case was transferred yesterday to Frankfurt as well. For now, therefore, we'll just sit on Packet 3 for the K3 for a while, expecting that the letter inviting my wife for an IR1 interview will arrive next week anyway. (There is no packet 3 stage for the IR1 anymore.) The Frankfurt Consulate has a reputation for being very quick...
