Hi LvivLovers,

Very interesting. So USCIS (CSC) ignored your attempt to clearly indicate you want consular processing for your I130. I can't say that I am surprised, but your experience will be valuable to others hoping to try the same thing (keep both the CR-1 and K3 options open).

Congrats on the getting your I129F forward to Kyiv!

I couldn't take it any more! We've been calling the NVC every day for 3 weeks checking to see if they received our I-130 yet and getting the same "have not received message". Also, I have still not received my NOA2 from either I-129F or I-130 even though CRIS showed they were both approved on Aug. 8. So today I broke down and called CSC using the RFE trick again. I found out that our I-130 had gone to the NBC and our I-129F had gone to the NVC on Aug. 30. (This shouldn't have been the case by the way. See this post for more info: http://www.visajourney.com/forums/index.php?showtopic=86217 ) I also called the NVC to confirm this and the operator there told me that our I-129F is now on its way to the US Embassy in Kyiv, Ukraine! So it looks like we will be making a K3 visa instead of a CR-1 and hopefully my wife will be here in less than 2 months if all goes well!

Best of luck everyone!

Yes. I sort of expected them to just ignore it right from the beginning. But I figured it was worth a try so we could have 2 horses in the race so to speak. The woman I talked to at CSC was actually an adjudicator and it was sad because I could tell she didn't understand the process nearly as good as we do on VJ. She completely couldn't understand the concept of having both the I-129F and I-130 active at the same time and just kept saying that would be too confusing. haha Oh well. It was to be expected, I guess! Good thing is I'll see my wife soon!!!!

Thanks again, and best of luck on your journey!

Ha! That's entertaining. We know more than the "pros" know.

I called NVC a few hours ago and they still hadn't received my paperwork. It sounds like 3-4 weeks is pretty much par for the course these days. I guess I should probably wait another week to call NVC. I'm assuming CSC won't pull off any miracles and get it there sooner. Oh well.

Just an FYI...if you had both your I-130 and I-129F approved around the same time, chances are, only your I-129F will be sent to the NVC, so make sure you talk to an operator and ask them about your I-129F. Just checking for your I-130 through the automated phone system won't help if they only transfer your I-129F in other words!

Wife's visa journey:

03/19/07: Initial mailing of I-129F.

07/07/11: U.S. Citizenship approved and Oath Ceremony!

MIL's visa journey:

07/26/11: Initial mailing of I-130.

05/22/12: Interview passed!
