Questions regarding possible Red Flags

Before I get into my actual questions and concerns, I want to make it clear that I have searched previous threads and I am still unclear how to proceed. Here is my situation: I was previously married. I met my foreign fiancee online (a pen pal at that time) while I was going through the process of getting divorced last year after 2 years of a very rocky relationship and having seperate lives except for finances and assets. Long story short Gareth (foreign fiancee) and I fell in love during this time and met in person in May of this year when we decided we wanted to get married. I have read that it is a possible red flag at Gareth's interview if the date my divorce was finalized is close to the date Gareth and I became engaged and started this whole process. I am not sure what I can provide him with if this comes up as an issue. I know I have a long wait till he actually has an interview, but I would like to be prepared. He has come to the US to visit me since my first visit to the UK (visit in May when we met in person) and I am going to visit him again in October. He has met my family and friends and I have met his family. I am not sure if I should have letters from my family and friends as proof that our relationship is solid and that we do intend on getting married. I don't know if just our correspondences (emails, phone calls, letters, etc.) are enough to show that we are serious. I don't know if I should write a letter. I am very confused and just need some clarity. If anybody can help, I would really appreciate it. Thank you!

I never heard of this being a problem. Divorces can take a long time to get finalized and before the final date a couple could already be separated and dating others. As long as the process has been filed, all parties can date but not get married (until the final date)

This is just my opinion as I'm not completely positive, But as long as you can prove your relationship, it shouldn't matter and if they ask too many questions about this, just remember, divorce is not against the law and i don't think they can use it against anyone. Just say you were separated and you guys were just waiting on the final date. Everyone has the right to move on, even if its one day after the final divorce date. In my opinion of course.

I can' help with an answer, however I can assure you that there are some people in the same situation. Including me :unsure: .I submitted my petition in just 2 days after my final divorce date , being separated with my ex for 1.5 y prior to that . It also worries me a lot because I read somewhere here on VJ that it IS a red flag....Just thought that I can't wait for another year, or even a half of year with submitting my petition until it looses its "redness"...

My timeline:

K-1 visa

05 - 16 - 2007 - Sending off of my I-129F package

10 - 16 - 2007-Got NOA2 !!!!

12 - 11 - 2007 Interview date

K1 visa -APPROVED!!!!!!!!!!

January 15, 2008 -married

Submitted docs for AOS ...but ,very unfortunately, my husband had to return back to Ukraine due to emergency without travel document (AP)

Starting K3 process ......

back to the waiting game...

K-3 route

07-10-2008-I-130 sent

07-15-2008-Check cashed

07-16-2008-NOA1 at CSC

07-21-2008-Hard copy of NOA1

07-23-2008-129F sent

07-27-2008-129F received at Chicago lock box (sent by mistake there instead of CSC)..

08-12-2008 I-130 NOA 2 !!!!!!!!!

08-16-2008-I-130 NOA2 hard copy

NVC

08-19-2008 Case is in NVC (Changed my mind and now going CR1 route)

08-21-2008 Got IIN

08-26-2008 Paid AOS Bill online

08-26-2008-Sent DS3032 by mail

08-28-2008 AOS shows as Paid

08-29-2008-AOS package sent USPS overnight

08-29-2008 Paid IV bill online

08-30-2008 IV Bill shows as Paid

09-02-2008 AOS package recieved

09-03-2008 DS230 sent USPS overnight

09-05-2008 Both AOS and DS230 entered in the system

09-12-2008- CASE COMPLETE!!!!! 23 days for NVC ?? !!!! YESSS!!!!

10-29-2008-INTERVIEW!!!!-PASSED!!!!

I am in the same situation too. We filed as soon as I got the paper copy of my decree absolute so I hope there will be no problem.

17th March 2010 - Started the removal of conditions process

22nd March 2010 - Application received by CSC

30th April 2010 - Biometrics appointment

I filed shortly after my divorce was finalized. and i even had an active petition filed on behalf of my exwife. I'm praying that they will not bump into each other as one is being canceled and the other is being reviewed for approval. As long as you are legally able to marry, you are eligible.

22 Jun 05 - We met in a tiny bar in Williamsburg, Va. (spent all summer together)

27 May 06 - Sasha comes back for a 2nd glorious summer (spent 8 months apart)

01 Jan 07 - Jason travels to Moscow for 2 weeks with Sasha

27 May 07 - Jason again travels to Moscow for 2 weeks of perfection

14 July 07 - I-129F and all related documents sent to VSC

16 July 07 - I-129F delivered to VSC and signed for by P. Novak

20 July 07 - NOA1 issued / receipt number assigned

27 Sep 07 - Jason travels to Moscow to be with Sasha for 2 weeks

28 Nov 07 - NOA2 issued...TOUCHED!...then...APPROVED!!!

01 Dec 07 - NVC receives/assigns case #

04 Dec 07 - NVC sends case to U.S. Embassy Moscow

26 Dec 07 - Jason visits Sasha in Russia for the 4th and final time of 2007 :)

22 Feb 08 - Moscow Interview! (APPROVED!!!)..Yay!

24 Mar 08 - Sasha and Jason reunite in the U.S. :)

31 May 08 - Married

29 Dec 08- Alexander is born

11 Jan 10 - AOS / AP / EAD package sent

19 Jan 10 - AOS NOA1 / AP NOA1 / EAD NOA1

08 Feb 10 - AOS case transferred to CSC

16 Mar 10 - AP received

16 Mar 10 - AOS approved

19 Mar 10 - EAD received

22 Mar 10 - GC received

At the interview, the CO will use many things to determine whether you should receive a visa. You are right that a divorce finalized within a short time of filing the petition can be a red flag. But these sorts of things are scrutinized more often at high-fraud consulates and couples that have several red flags may run into difficulties.

We filed just under 2 months after my divorce was finalized. No issues at all.
