This may be a dumb question, but when it says all those immigrating with the person, does that include me and our children? I am a US citizen, so that wouldn't include me, right? And what about our kids (who were born in Canada, but will be recognized as US as well). I just didn't know if 'immigrating' was being used in the literal sense or if it just meant moving with him.

Thanks,

Tammy

Interpretations should be literal. If your children are traveling on US Passports, you don't list them as immigrating.

Facts are cheap...knowing how to use them is precious...

Thank you all!!

If we file for a consular report of birth abroad, that will be enough to move them to the US right? We don't have to get passports for them....or do we?? Is it advisable to just get the report of birth or is there some reason to get both?

Another question....

It asks for all the places he has lived since he was 16. He can remember the places, but not the actual months/years. He moved a lot a lot a lot when he was younger. So, are they super picky about this or if he gets a month or year wrong, will it be ok? I don't even know if they try to check that stuff but I don't want to do anything that will mess us up.

Thanks!

Hi Tammy,

You and I have discussed this a bit, but I guess there is one point I forgot to mention. The consular report of birth abroad and the passport serve two different functions, but there is a cross over.

- A passport is fundamentally just a travel document

- The consular report of birth abroad proves your children's U.S. citizenship

That being said, the passport serves the dual purpose of also proving their citizenship - however - the passport will expire in 10 years - the report of birth abroad is a permanent document.

So do you need both? Not really. However if you want your kiddies to have a permanent document that proves their citizenship then you must get the report of birth abroad (or if you decide once you have moved to the U.S. that you want a permanent document for them you will need to apply for an N-600 once you all leave Canada). You will one day (possibly soon if the Canada/U.S. border situation pans out the way they are saying it probably will) want to get them passports as well, so that they can travel and enter into the United States. For now you can cross by land without the passport - if you fly you will absolutely have to get them passports.

Another question....

I'm not sure how picky they are about this, perhaps someone else has a take on this. We did the best we could with the dates, I'm sure it's not perfect though.

Thanks trailmix! Yeah, I just wanted to make sure I was understanding the whole passport/report of birth thing. I thought I did when we had talked about it and then I read somewhere that they needed their passport to move to the U.S. But it could have been that the person just simply omitted saying the report of birth, not purposely. Thank you for clarifying, once again ;)

This form is really getting to me! LOL Maybe you can help me with a couple of other questions I have (and sorry if these are so elementary). I am trying to get things started ahead of time and because I'm not actually to that place in the process yet, I may be misunderstanding a few things.

On the actual DS-230 form:

1-#11, asks for address for PR card to be sent to if different than address in #10. I put my mom's address in #10 and I guess I would use that for the PR card? If so, do I leave it blank or put N/A?

2-Kinda the same with #14. It asks for address of spouse if different that that of applicant. Do I leave it blank or put N/A?

3-#33a "Do you want the SS Administration to assign you an SSN (and issue a card?" Do I answer yes or no?

4-#33b Consent to Disclosure - do I answer yes or no?

5-#34 "Were you assisted in completing this application?" It's for my husband but I filled it out. Do I answer yes and put wife, or do I answer no?

6-For the list of things to send in with the DS-230, am I right that they all have to be original forms? They can't be copies like what was sent in with the I-130? Or can they be photocopies of the original?

7-How soon can I sent in all of this (the whole DS-230 package)? Do I have to wait until I receive the package from them?

8-Is it ok that I downloaded the form and filled it out or should I be filling out the form that they send me?

9-I was reading the shortcuts from James. When can I do this? Do I get that number that I need after my I-130 interview? Can I do it then? And how much time does it save? If I didn't use the shortcut, how much longer would I have to wait to send it in?

Man, I think that's all. You all can't even begin to imagine (well, maybe you can) how much you have helped. I have had SOOOOOO many questions and all VJers have been so extremely helpful. I was just telling my husband today that I have no idea what I would have done had I not found this site. I have found out so many things that I don't think I would have found out as early as I did, thus losing us precious time in this whole process.

Thank you to all of you!!!!!

Tammy :)

Hi Daisylynn,

I'll take a shot at answering your questions. As for James's shortcuts, once you have gone over them a few times if you aren't completely comfortable with them I would recommend you don't use them. If you don't get them right they could in fact hold up your application rather than save you time.

On the actual DS-230 form:

1-#11, asks for address for PR card to be sent to if different than address in #10. I put my mom's address in #10 and I guess I would use that for the PR card? If so, do I leave it blank or put N/A?

If the address will be the same, put in n/a - best never to leave a field blank.

2-Kinda the same with #14. It asks for address of spouse if different that that of applicant. Do I leave it blank or put N/A?

Same as above

3-#33a "Do you want the SS Administration to assign you an SSN (and issue a card?" Do I answer yes or no?

Depends what you want to do. If you say yes, in theory, they will forward his information and your Husband will receive his SS card. In practice, from what I have read in the Canada forum this doesn't happen most of the time and they end up applying themselves. For us I marked 'no' - so we will apply when we get there.

4-#33b Consent to Disclosure - do I answer yes or no?

Yes is the answer here.

5-#34 "Were you assisted in completing this application?" It's for my husband but I filled it out. Do I answer yes and put wife, or do I answer no?

That's up to you, I would personally put 'no' - most Husband's and Wives probably fill it out together in some form or another.

6-For the list of things to send in with the DS-230, am I right that they all have to be original forms? They can't be copies like what was sent in with the I-130? Or can they be photocopies of the original?

For the DS-230 they want originals, not copies, I believe the exception is the copy of the passport biographic page (check the list I posted in your other post).

7-How soon can I sent in all of this (the whole DS-230 package)? Do I have to wait until I receive the package from them?

As with all the forms, you can't send it to them until they are ready for it. You can use James's shortcuts and when you know it is being sent to you, you can go ahead and mail it - it's important not to send anything to them until they ask for it.

8-Is it ok that I downloaded the form and filled it out or should I be filling out the form that they send me?

Yes, no problem with that. As Margo mentioned in another post to you, just always double check on the gov website before you send it off that you have filled out the most recent version.

9-I was reading the shortcuts from James. When can I do this? Do I get that number that I need after my I-130 interview? Can I do it then? And how much time does it save? If I didn't use the shortcut, how much longer would I have to wait to send it in?

I'm not sure what you are referring to here - regarding the number? James's shortcuts shave off a couple of weeks in mailing time. Basically with his shortcuts you self generate the barcode-sheets and forms and when you know they are waiting for them you mail them off, which saves you waiting for them in the mail.

trailmix-Thank you! Thank you! Thank you! What a HUGE help!

I just have a couple of questions in response to your answers. For applying for the SSN (or checking the box yes), that's what I had heard (about people not getting theirs) so I wasn't sure how to answer. Will it delay him getting one if we answer a certain way or will it not really matter? If we check yes and still have to apply, will that take longer since we should have already gotten one?

On the shortcuts, it asks for the case number (sorry, I should have put that in the first post.) But I won't get that until after my interview in Toronto, right? So, do I have to wait for that day (will I get it that day) or wait until they send me something? Speaking of that, what exactly happens that day? They approve the I-130 application I know, then what? Do they give you stuff then to fill out or is that sent? How does that work?

And that list you posted in the other thread has everything I will need to send back with the DS-230? So, if I send that back before the paperwork gets to me (but after I know they've sent it-how will I know it's been sent btw?) then I'm ok to send what's on that list?

Thanks!

Tammy
