how do I respond to this question

Hi Everyone

It's been a while since I posted anyting, too busy working and enjoying my new life in America, How time flies, it is almost time to send off my I-751 for lifting of conditions. On looking over the form there is one question I am not sure how to answer.

In part 3 question 7 asks, have you ever been convicted Etc I did have one small blemish on my record which was disclosed on my original I-129F and discounted as a misdemeanor and ignored by the INS. Unfortunatley I cannot find the copy of the I-485 as we have had a lot of work done to our house and don't remember how we handled this question.

any help or advise will be appreciated as it always has been

august 20-NOA2

september 16-recieved pkt3

september 28- returned pkt3

Sent several emails to embassy asking when was interview date

Novemmber 2- email confirming 19th Nov as interview date

November 2- embassy posted packet 4 but it never arrived

November 10- rang embassy

November 11- finally recieved packet 4

November 19- APPROVED

November 23-recieved visa

december 31 2004 arrived in atlanta

2005

January 7 we got married

January 14 applied for ssn, not in system

January 28 still not in system

Febury 8 sent off aos and ead

Febuary 11 recieved in chicago

febuary 11 in ssa system

Febuary 19 recieve ssn

March 1 NOA for EAD arrived

March 2 NOA for AOS arrived

March 5 biometrics and fingerprint appointment

March 23 got drivers license

March 31 EAD approved on line

April 7 EAD card arrived

April 10 Got a job!!!!!!!!!!!!!

Octobe 13 case transferred to csc(aos)

December 24 RFE

January 19 AOS APPROVED

The question on the I-751 asks:

Have you ever been arrested, detained, charged, indicted, fined or imprisoned for breaking or violating any

law or ordianance (excluding traffic regulations), or committed any crime which you were not arrested in the USA or abroad?"

So, what is the answer for you?

Criminal History.

If you have ever been arrested or detained by any lawenforcement officer for any reason, and no charges werefiled, submit:

1.

An original official statement by the arresting agencyor applicable court order confirming that no chargeswere filed.

If you have ever been arrested or detained by any lawenforcement officer for any reason, and charges were filed, or if charges were filed against you without an arrest, submit:

2.

An original or court-certified copy of the completearrest record and/or disposition for each incident, (e.g. dismissal order, conviction record or acquittalorder).

If you have ever been convicted or placed in an alternativesentencing program or rehabilitative program (such as a drugtreatment or community service program), submit:

1.

An original or court-certified copy of your sentencingrecord for each incident, and evidence that you completedyour sentence, specifically;

A.

An original or certified copy of your probation or parole record, or

B.

Evidence that you completed an alternative sentencing program, or rehabilitative program set aside, sealed, expunged or otherwise removed from your record, submit:

2. An original or court-certified copy of the court ordervacating, setting aside, sealing expunging or otherwiseremoving the arrest or conviction, or

3. An original statement from the court that no record existsof your arrest or conviction.

NOTE: Unless a traffic incident was alcohol or drug related,you do not need to submit documentation for traffic fines andincidents that did not involve an actual arrest if the onlypenalty was a fine of less than $500.00 and or points on yourdrivers license.
