Did this happen in the US or in the Fils?

Where was the divorce filed?

these are questions the OP was not specific. divorce is not legal in the Philippines.

I see from previous posts the fiance has been here previously in the US on a 'tourist visa'. So can we assume the 'marriage' took place in the US?

I can see the possibility of a false marrige occuring in the Philippines. It doesn't seem likely it could have occured here.

Are you kidding Melody? that is some very bad advice. read what i kept in his quotes. their whole relationship will be questioned and her motive for coming to the USA. they need a very good attorney and immigration lawyer. your case and theirs have nothing to do with each other. did you marry your ex at the same time you met you current husband and started your current relationship???????

Wow, sorry i took so long to respond. I had no idea this would be such a big problem since the divorce is already finalized. But to answer your questions, the marriage license came from the Philippines, im not sure if there's another one that came from the States. The divorce certificate on the other hand is from the states and is finalized w/ my fiance's and the man's signature. Also the CENOMAR is already completed. We have no idea how the auntie pulled this one off w/out my fiance being present at time of marriage. The marriage took place in 2004; she was on a tourist visa last year already unknowingly married.

I think the important thing is the divorce is finalized, and we have all the evidence we need of a true relationship.

Did the marriage take place in the Philippines?

Under the new Family Code of the Philippines , if its the alien spouse who files for the divorce, even if the marriage was celebrated here in the Philippines, the Filipina ex-wife is again free to marry even if divorce is not recognized in the Philippines. But, the process doesnt end there. The Filipina ex-wife must file a Petition before the court in Philippines, particularly in the Family Court , if any, so the Decree of Divorce obtained by the Alien spouse from the USA will be recognized in the Philippines for purposes of remarriage for the ex filipina wife.

On second thought, if your fiancee was not present during the marriage ceremony and was not aware of it ,definitely there was no consent and the marriage was null and void from the very beginning.

The Auntie must be very good to pull it off.

so u got the CENOMAR?!if they state in the CENOMAR certificate "DOES NOT APPEAR IN OUR NATIONAL INDICES OF MARRIAGES " then, their marriage is not registered,or could possibly be invalid.

This case is really odd!!! Unbelievable!!!

Yes unbelievable is EXACTLY the word I was looking for. It sounds to be like something is up with the fiance's honesty. I find the lackof the OP's concern/pursuance of the what actually happened a bit unsettling! If that were me I would want to know EVERYTHING that happened with "auntie". Even if her "close circle of family/friends" are the only people who know what REALLY happened. This is his life and I feel he isn't delving into it like he should. I would file charges against "auntie" if there is such a beast. I feel like he is too trusting with this highly unlikely story. Cause it sounds wayyyyyy too shifty to me. I am naive yes I don't believe his fiance'.

I suspect this will be one big mess.

If she was never (truly) married, then her "divorce" is not real either.

I hate to say this, but you need a lawyer for this. Her Auntie would surely get in trouble (as well she should) for forging a signature on government papers. But, then who knows, they may never ask...

I don't think we have the whole story yet

If the embassy requires a CENOMAR they will order it themselves. I don't understand how this can take place without both knowing of it otherwise, even in the Philippines, it would be fraud. This is so confusing......I don't think all the facts are presented yet.

The marriage certainly could have occured in the US. There is a county in Montana that will legally marry people by PROXY.... I am sure they have some safeguards in place but it is not outside the possibility that the system was beaten.....

I'm thinking the same thing. Marriage is probably one of, if not the most important decision you make. The story given is really, really strange and I also would keep digging and digging until you got the full story. Do you really want to blindly go into this situation and work so hard and have everything denied? Worse, do you want to take part in a possible deception, bring over a woman who doesn't have your best interests in mind, get her a green card, get her citizenship, then have her divorce you and bring her first husband over?

You can't just blindly trust everything in a situation like this. You have to understand that there are definitely people who will pretend, lie, and do crazy things to come over to the US and use gullible people who are vulnerable and lonely.

Sorry to be so blunt, but there are too many red flags in the story and situation and if I were in that position I'd back up a few steps and really investigate this situation and get the full story.

Like others have said - does the story make sense? What did this 'aunt,' have to gain? What would the US citizen have to gain by claiming a wife he never met? How exactly did this arrangement work?

I was wondering the same thing. Perhaps her "auntie" lives in the states and was previously seeking a way to keep the neice (the beneficary in this case) in the States. Fraud, basically. That relationship obviously didnt work out. And I'd be willing to bet that there was a previous K3 style visa in the works back then. If the USCIS senses this from her past, there's no way they will approve a new K1 for her. This is a huge mess. i'm so sorry for the OP, but this just doesn't sound legit. Wow!! This is horrible problem! How did I miss this thread for sooo long?
