My fiance's auntie somehow married my fiance to another man from the states without her even knowing it back in 2004, around the time i first met my fiance. This was done for the aunt's personal reasons as no one in her whole circle of family knew about the marriage. We were getting ready to file for the K-1 visa a few months ago, but got lucky and found out about the false marriage. To make a long story short, the guy agreed to file for divorce, and that completed just a couple of weeks ago, so we can now start the visa process. I wanted to get the marriage annuled but that would've been a more lengthy and more costly process.

My question is will this pose as a problem when it comes time for the interview or when they are reviewing the paperwork. Because they will notice she got married in 2004, but my statement will say we met around that time and started our relationship. I'm thinking it's best we just come open w/ all this so we dont have to hide anything from them; we'll state on the papers what exactly happened and that my fiance never knew about the marriage. If we do this will anyone get in trouble?? We have the marriage certificates, and my fiance's signature is not really hers. What I really want is to get her here as soon as possible w/out any problems & w/out anyone getting in trouble. Any advice?

I'm still reeling from that statement. I didn't realize that in the Phillipines it is possible to get legally married without knowledge of the bride.

I am pretty sure that in the U.S., a signature from the bride would be required for a legal marriage.

I do agree that you should be honest with the situation, and explain the situtation in your inital filing, as it would seem peculiar.

I suspect this will be one big mess.

If she was never (truly) married, then her "divorce" is not real either.

I hate to say this, but you need a lawyer for this. Her Auntie would surely get in trouble (as well she should) for forging a signature on government papers. But, then who knows, they may never ask...

I guess it is better for you to hire a lawyer and explain everything to him and also I guess it is better to make a statement explaining about that false marriage when you file the petition. You should also convince the consul that your relationship is genuine.

If the OP's fiance never signed the original marriage license and certificate then I'm also assuming she wasn't even present at this "wedding", correct? Then wouldn't this be a case of identity theft and that she was never really married to this person in the first place?

Did your fiance sign the divorce papers as well even though she was never really married to this man? If it was a case of identity theft/fraud without her knowledge until recently, there could be issues if she did indeed sign the divorce papers. It could be an issue with the consulate (e.g., if she really wasn't married to him, never signed the marriage license and certificate, then why sign the divorce papers?). I think you may want to seek advice from both a divorce attorney and an immigration attorney.

Well, it doesn't explain it. But if she had a tourist visa, she would have had an A number when that visa was issued, which should have been reported on the I129F when it was filed.

So USCIS should easily be able to ascertain if DOS previously issue a tourist visa or some other type of visa. If there is a discrepency in that situation, they will most likely be advising the OP of same.

LET ME GIVE YOU SOME BASIC TO THE POINT ADVICE.....IT WILL NOT BE A PROBLEM.....I DIDNT GET A DIVORCE FROM MY FIRST HUSBAND BECAUSE OF FINICIAL REASONS......MY DIVORCE DATE IS SHORTLY BEFORE I FILED FOR MY K1....NO PROBLEM....YOU DO NOT NEED A LAWYER , JUST TELL THE TRUTH AND ALL SHOULD BE FINE....I AM SPEAKING FROM MY OWN PERSONAL EXPIERENCE(ONLY).
