Hey, everyone. I am thoroughly confused about how to help Réjean apply for EI. I'm sorry if this is a stupid question; I'm just so confused that it's making my head spin.

From the Service Canada website, it says, "Employment Insurance (EI) provides Regular Benefits to individuals who lose their jobs through no fault of their own (for example, due to shortage of work, seasonal or mass lay-offs) and are available for and able to work, but can't find a job." Well, he's leaving on his own accord due to getting his visa. His last day at work is on Friday. He even called and asked about getting EI benefits, and they said he wouldn't be eligible since he's quitting!

Someone please help. The "The Canuck EI Thread" only picks up where the old one left off (that no longer works), and the "EI Issue" thread doesn't start at the beginning either.

They have to put relocation to be with spouse....or along that lines on his ROE.

I managed to get that part :blush:

Whether Rejean has been given a ROE or not, tell him to get on-line and apply for EI. He will get a letter in the mail some time after that, and will maybe get a phone call as well. When he gets his ROE, he will have to make a copy and mail it to Bellville, Ontario, which is the international EI office (I think they call it Inter-state). Anyway, he'll have had contact with them by phone or through the website by then, so he'll know where to send it. He is eligible to receive EI beneifts when he moves to the USA for marriage. He can receive benefits until his I-94 expires, and then they are suspended until he gets his EAD or Green Card, whereby then he'll fax them a copy of the document giving him permission to work, and he'll have his payments resume.

Note that he'll be paid minus a 25% withholding tax. If he still has a Canadian bankaccount, he may wish to just have the payments direct deposited there as well. One he applies on-line, they will send some papers and maybe cards for him to fill out. There is a link, I'm sure in the other thread that I posted before, and it gives you the "official" basis by which a K-1 visa is eligible for EI beneifts based on their ability to work, even without a work authorization stamp from the border. I know...I know...it sounds confusing, but as K-1 visa persons we have the authority to work until our I-94 expires without a stamp from the border, for EI purposes only.

You must also apply asap. I think it's a month deadline basically. Again, whether you have your ROE right now is irrelavant. Apply on-line immediately.

So, check out the other thread for the link. If you can't find it, let me know and I'll repost it. Print it out, and highlight the appropriate section and mail it back to them once you've had contact with them.

Yeah you have 1 months after he quit his job to apply, but he must apply once he is in the US to avoid more paperwork from them, but I know he moves right after he leaves his job so that shouldn't be a problem.

In the application online (which he has the options to do it in french as well if he feels more comfortable, that's what I did) it will ask where you live now, why you left your job, etc, there is the option to write that he left to be with his fiancee, and then they will ask you did you marry since the move, and if you answer no (thats what I did cause my wedding was 1 week after I applied) they will ask you to provide at which date you plan to be married.

When they will askyou for more information through mail, you send his ROE and mariage certificate, et VOila! ;)

I didn't do applications on my K-1 because I didn't have the stamp, but right before taking a decision they called me and I explainined to them my confusion with the K-1 thing, and technically to be eligible he should make 3-5 applications per week during the 90 days of his K-1 ( which I didn't do thinking I couldnt be hired anyways) but I told them I had already my list of addresses and I was talking to some contacts so they wrote in my file I was looking for work. BUt make sure he makes applications anyways, can be anything really, McDonalds or White castle :lol: even as long as its an applications ;)

If you browse in the EI issue, trying not to curse thread you will find the list of paperwork to send them once they will send him the first enveloppe :)

Rejean has to tell his employer to put on his ROE where they check off quit " Relocation for Marriage" quitting for this reason allows EI eligibility

Looks like I'll be in this boat soon as well. Just wondering if by law your employer has to give you a copy of your ROE or do you have to ask for it specifically? Also, when they list "Relocation for Marriage" is that just added to a comment section? I work for a large company and everything here is done electronically so I want to ensure that my reason for quitting is documented!

Looks like I'll be in this boat soon as well. Just wondering if by law your employer has to give you a copy of your ROE or do you have to ask for it specifically? Also, when they list "Relocation for Marriage" is that just added to a comment section? They have to give you a copy of your ROE by law and within a certain period of time. Yes, tell them to mark down relocation for marriage in the comments section. Payroll will know what to do. Follow up with them if you need to.

One should have the reason to moving on the ROE, but if you do not, its not a killer!! My roe didnt have it!!! I just called the 1800 #and talked to a rep on the phone!! He emailed me the link and off I went!!!

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

Mine said "E" but box 18 was also filled out "Relocation due to marriage". I told HR & Payroll to make sure it had that notation. Something I learned here on VJ months ago... "relocation due to marriage" is a valid reason for quitting and still being able to collect EI.

FWIW, I'm not currently collecting EI but my claim is open. I've got my EAD and I'm making money, the claim is still open in the event that I cease working before my claim is up (1 year from... I think the last day of employment with my previous company).

The law may be that your employer is required to issue you a ROE within 5 days of your leaving, but I would suggest, especially if you're waiting for your last paycheck (with calculated vacation pay or whatever), that it may be longer than that. As well, if they're sending it to you in the US, the mailing alone will take a longer time. Some companies don't even do their own payroll and such, a Head Office will have to process it. Again, I stress...do NOT wait for the ROE. File immediately.

My ROE had nothing on it about relocation for marriage, so if it's not on there, don't worry about it. There are places on-line for comments, and as such, you can fill that in there. Of course you have to quit to relocate, so if it just says quit, and you put in "to relocate to marry in USA", that will suffice. I'm sure they're going to call you anyway, so if there are any questions you can answer them directly.

I'm only mentioning all of this because waiting until you get your ROE, or trying to get a certain box to say a certain thing before applying or submitting it, will possibly jeopardize your claim.

Yeah the relocation for marriage on the ROE shouldn't be a big issue if not there.

You got a Visa and a marriage certificate in the end to prove it, and a US address.... ;)
