Hello there,

-I am the petitioner

-My wife is the only person immigrating

-I am only using my income (No assets, co-sponsors)

Currently, I am in the process of filing I-864 EZ for my wife. In Line 18, it says "My Individual Annual Income is currently:" Now, during 2006 tax season, I was employed by a different company making around 50K.

I have changed my job since then and moved onto a better paying job in April of 2007. Which salary do I use for the purpose of this form I-864EZ? Do i use the old salary (shown on my tax return) or my new salary (possibly a letter from the new employer)?

Anybody here with a similar situation?

That's right :thumbs:

Your annual income salary from your new position will be verified anyways by your Employment Letter from your current employer.

Do not forget the following:

*Letter of Employment

*6 months paystubs

*barcoded coversheet

*3 years Federal Tax returns (photocopy or transcripts, from 2004 thru 2006)

As for me, I included a coverletter, and placed a page markers at every first page of the documents so they can easily locate each document for review.

When we did the AOS interview last December they only looked at {and added up} the the year before [2005] ITR.

Nothing about what the "current" income was.

Good to have record of how much you are making currently tho.

Get tax transcripts from IRS for the last 3 years as they are more valid than ITRs.

Quick and easy to do. Call 24/7 1 800 829 1040. Takes about 7 days to get them and they are free.

I sent in copies of my Tax returns, W-2's, and 1099's for years 2004,2005, and 2006.

I sent my Employer letter, copies of Tax returns, copies of 1099's and original W-2's to Tuyen for her interview.

I-130 Approved : 2007-01-17

NVC Received : 2007-02-05

Consulate Received : 2007-06-09

Interview Date : 2007-08-16 Case sent back to USCIS

2005 and 2004 are optional from what it is written from the I-864. As long as you are currently making above 125% of the poverty line, and you have all your IRS transcripts/ Federal Tax returns, W2s, Paystubs and Employment Letter, you should be ok.

2005 and 2004 are optional from what it is written from the I-864. As long as you are currently making above 125% of the poverty line, and you have all your IRS transcripts/ Federal Tax returns, W2s, Paystubs and Employment Letter, you should be ok.

In that case what would i put down for Question 19 on I-864EZ (3rd most recent year)? Just "N/A" that?

On page 5 of I-864EZ, the second paragraph on the left: :reading:

"...If you are not required to file a Federal income tax return under the U.S. tax law for any other reason, attach a written explanation including evidence of the exemption and how you are subject to it..."

Another important thing is this...Under Part 1.."Qualifying to use the I-864EZ, If you are self employed, you can NOT use the I-864EZ...you must use the I-864

Also, it states that "if you file your taxes using the IRS 1040 and 1040A, the line of gross(total income) will considered when determining income....If you file your taxes using the IRS Form 1040EZ, you use the line for "adjusted gross income"

I think that the line for current annual income is the amount income that you filed taxes for in the previous year..I don't think they are asking what your income is currently to this date..I think the key word there is "annual"..

If you have W2s and 1099s use them also.

I've seen if you use tax transcripts W2s and 1099s are not required.

In our case I didn't have either and sent the ITRs and tax transcripts for 3 years.

Your income from the job you have now.

I would also suggest you take out insurance on her thru your work.

Even though you do not have a ssn yet, a copy of the marrage certificate and they have to honor the marrage with insurance.

Soon asd you get the papers. Include them to show you have allready accepted financial responcibility of your wife.

Jan 10 2007 got receipt and case number!

Jan 12 2007 sent 129F

Feb 6 notice they were moving the file to a faster service center.

Feb 26 Notice of I130 approval

Feb 28 2007 notice they were sending 129F to USCIS for further investigation (err #######?)

May 15 2007 notice of approval of 129F with processing dates of 05/15/2007 thru 09/14/2007

May 28 2007 Notice from attorney that NVC needed processed and money orders were needed.

June 4 2007 Traveled to Manila to spend 2 weeks with my wife!! (YeHaaaa!!)

Fed-xed her signed papers (For NVC) from Manila to attorney from Manila while on vacation

June 18 2007 Nvc approved support.

June 29 2007 packet arrived @ my home informing of interveiw for I130 on Aug 27 2007 and explaining Medical interveiw.

(Note wife never received packet for I130 in Philippines I fed-ex'ed mine to her for medical interveiw)

July 17 2007 packet arrived for 129F setting interveiw for Sept 5 2007

August 5 2007 Wife flew to Manila for medical interveiw on August 6.

August 26 wife flew to Manila for I130 interveiw on August 27 2007.

August 27 2007 12:31 pm I130 Approved

wife arriving Nov 18th

WIFE ARRIVED Nov 18th!!!!
