Hun, I'd be getting me a new lawyer. Really.

Lawyers have access to information we don't when they act as your agent. I personally don't know how they do that, but any lawyer worth their immigration salt should know how. There's no reason on earth your lawyer shouldn't be able to find out what is going on here.

If your denial is because of RFE's I think a motion to reopen is the appropriate action.

Whether I am right or wrong about that, I don't see how you can fight what you don't know. And I don't believe your lawyer cannot find out.

Well, my immigration headache is pretty much done with for now. I think in my case it's the fact that my husband just left for Iraq and I'm pregnant LOL. My hormones are out of whack. I'm usually a friendly, non-confrontational person so yesterday was kinda out of character for me. Again, sorry.

As for my friend, yeah, definitely. I have friends in Germany right now who plan on coming here on a tourist visa to get married. I keep telling them all not to do it.

That's great that you're done w/ immigration for now! May I just say I'm jealous? :lol: (They've yet to even cash my AOS checks...!)

I'm SO sorry to hear that about your hubby - what lousy timing, too, with you being pregnant. (Not that there's ever a good time to be deployed, but I'm sure you know what I mean.) But MANY congratulations on the baby - you must be over the moon! :)

I will keep your hubby in my thoughts for his quick & safe return. All of us here owe our servicemen/women a huge debt of gratitude.

Well - your friends can come here and get married on a tourist visa, so long as the non USC returns to Germany afterwards! There's nothing wrong whatsoever in coming here on a tourist visa/VWP and marrying (as I'm sure you well know).

It'd be great if they DID marry here - maybe you could make it to the festivities! :)

Don't be jealous! You'll get it soon. Had my husband not gotten orders to leave, we wouldn't be done yet either. So it's a good thing I got the GC but what a way to get it, know what I mean? I updated my timeline a gazillion times but it won't change my status to approved - still says pending. I have no clue why it won't change.

Yeah, the timing is horrific. Over the moon? LOl, I'm over the toilet for most of the day! hehehehe

I understand what you are saying but in regards to the lawyer being able to find out information on the case the reason that she is unable to find anything out is that our file is still in Missouri and not in our home state yet. With out the case being in California we can't find the information out untill then. So right now its just a game of waiting and fighting against time.

I don't understand what your case 'not being in our home state yet' has to do with the attorney not being able to get information. As RJ said, any immigration attorney worth a damn should know how to get information on your case.

The OP has stated that their lawyer has contacted USCIS and is having USCIS resend the denial notice. So again, I don't see why everyone wants to diss their lawyer. The lawyer is indeed making the effort to find out what's going on with their case.

Because lawyers who officially represent the 'customer' by registering as their representative at uscis.gov have access to departments at that agency that the customer does not.

And because this lawyer still seems clueless to what's really going on with the case.

That's why.

I'm a HUGE advocate on this site for use of an attorney. But because I've read the horror stories here, and because I work in the profession, I'm also a huge advocate of finding competent counsel first. My radar is telling me this lawyer doesn't pass muster.

So you are saying Lawyers have access to information that individuals cannot access? What specifically is this information?

Good Morning everyone, I have wonderful news regarding my husbands case with USCIS. We got a email this morning and here are the exact words from the email.

Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

Current Status: Case reopened or reconsidered based on USCIS determination, and the case is now pending.

We reopened this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS on August 27, 2007, and are now reviewing our earlier decision. We also mailed you a notice describing the next steps in the process. Please follow any instructions on this notice. Our review should be completed within 30 days. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service.

All I have to say is Alhamdulillah (Thank God) they have reopened our case and the amazing thing is that we never sent in a appeal to reopen or anything. We never even hired a lawyer just went and talked to someone. All we did was request that our file be transfered to the CSC so we could see why it was denied the first time around. So inshallah (God Willing) this is a good thing and the next step will be interview.

I will keep you all informed of the next step.
