We are going to a second AOS meeting next month (we failed the first one due to a lack of preparation, a lack of documentation... mostly due in part to blindly following the advice of a lawyer instead of preparing for ourselves).

We will be going to this second AOS meeting without a lawyer's assistance.

From what I understand, the likelihood of my wife and I being separated and "quizzed" (Newlywed Game style) is likely. This type of interview is a "Stokes" interview.

The lawyer we were using wanted to charge us $3,000 USD to prepare for this Stokes interview -- we parted ways with this lawyer after the first interview went so poorly.

Any idea what preparation services the lawyer was going to provide?

Okay, I'm a bit late in updating this since it happened almost 2 years ago, but I got an email from someone using the site who asked for an update so I'll write this up now. I really appreciated the stories I read here before the interview -- it was comforting to know people had gone through the process and were successful. We got through it too.

As I said in the previous post, our first interview went poorly due to a lack of preparation. Some of the things that were asked for during the first interview that we didn't have:

- our actual apartment lease (not just documentation of rent paid from a joint account). The lawyer told me not to bring the lease because it only had my name on it.

- vacation pictures of us together beyond what was submitted in our application. The Interviewer was disappointed the pictures we brought of a vacation was 1 picture of me, 1 picture of her... Not us together, even though they were in front of the same bird, same zoo animal, or same beach...

- testimonials from friends/family.

We parted ways with that lawyer and I started looking around for another one for the Second Interview. I spoke to a lawyer (over the phone, for free) who seemed to be really on-the-ball. He advised that a lawyer's presence was not going to be very helpful during a second interview, so I stopped looking for another lawyer and instead focused on generating more documentation.

We got testimonial letters from friends and family.

We went on a vacation and got a lot of pictures of us "in the same shot."

We got our lease. And we brought a letter from my landlord saying he knew my wife was living in the apartment too -- the lease was in my name alone because that's how I had originally rented it.

We went to the interview with all the original documentation plus this new stuff.

We got a different Interviewer than before -- the second interviewer was "head interviewer" at the San Francisco location -- she asked us where our lawyer was and I explained the situation:

"I put too much trust in the lawyer we used to prepare the immigration documentation. We paid her 5k and I followed her advice blindly. I don't think we were well prepared for the first interview, and it went really poorly straight from the beginning. We didn't have the information our Interviewer wanted."

"After the first interview went so badly, I talked to some family and friends about my concerns that paying the same lawyer another 3k to assist in the second interview would be throwing good money after bad. The people I spoke to (some of whom were actual lawyers) said that the second interview would likely be a 'Stokes Interview' and that a lawyer was not going to be any help in that situation -- you'd either pass it or fail it."

Full Disclosure: I did get advice that a lawyer might be able to help in a few "Second Interview" situations if things went really badly -- like if the Interviewer asked illegal questions or pressured us individually using some kind of tricky police techniques into saying marriage was a fraud -- but I didn't mention that to our Second Interviewer.

When I mentioned 'Stokes Interview' she said that she hadn't heard that term in quite a while and asked where I had heard it from.

I explained that I read about it on the internet and talked to a lawyer in Philadelphia (family friend) and that's what they called it there.

She asked me what I knew about a 'Stokes Interview.'

While she was asking these questions, she was looking through our original paperwork while I talked, not looking at me but obviously listening. I got the feeling though she was observing us with her peripheral vision.

"As I understand it, it'll be like the Dating Game -- you'll separate us and we'll be asked a bunch of questions about eachother and our daily lives. Questions like "what'd you have for family dinner last wednesday night," "what color are your blankets", "what side of the sink do you keep your toothbrushes," and stuff like that.""

She asked if we had practiced, and I said I had: "I memorized all the colors of everything in our apartment, counted all the clocks, learned her parents' birthdays, her coworkers' names, all the stuff I wouldn't know unless I was going on the Dating Game. We've been quizzing each other for a month."

She asked me if I thought that would help, and I said "I don't know, but it couldn't hurt. We wanted to be prepared this time, and that's the only thing we could think to do."

She then asked me if I knew it was a crime to have a fake marriage and I said yes -- she asked me if we knew the penalties and I said we didn't need to because we don't have one. She laughed. She said this was serious business. I agreed. She looked at us pretty closely while talking about the penalties for a fraud marriage and asked us both if the marriage was genuine. We both said yes.

She knew we had brought additional documentation -- the lease, the photos, the testimonials -- but she "passed" us without looking at them!

She stamped something and said she "we are done here" and I asked if we passed and she said with a smile, "yes!" We exhaled deeply -- big weight off -- smiled and thanked her.

She did take the documentation afterward to "put them in our file." When she took the documentation she read the testimonials and flipped quickly through the vacation pictures.

The second interview didn't take longer than half an hour. A month of preparation for nothing! Or maybe she could see we were prepared?

As we were getting instructions on what we had to do next, I asked if she thought a lawyer would be necessary for the remainder of the immigration process -- she said she couldn't give legal advice but smiled and said that judging by how much we prepared on our own for the second interview, we shouldn't have any problems doing the rest of the process without a lawyer.

I think she appreciated we didn't bring a lawyer with us.

That's how it went -- sorry I don't have a full timeline... I know its been almost 2 years since our second interview and we need to submit some new form in a few months. I don't know the form name though... I guess I should get back in touch with the 'immigration world' because I don't ever want to have a "hiccup" like our first interview again!

Apologies if this was too long -- just wanted to share all the details I would've been interested to know if I was headed into such an interview! I hope yours goes as easily as ours did!

They get personal when doing the second interview. If you have a "for real" relationship you won't have any problems. There isn't any preparation. They ask questions you should know if you are living and sleeping together.

True Haole. A true tpgether relationship creates an impression and most of these people have experience to see that apart from some thugs. Great way of handling the case SanandDiane. I wd appreciate and give a bravo for your courage and confidence. I think the 2nd interviewer saw the truth & confidence when you spoke to her and thats was what vouched to her for the genuinity. What visa were you adjusting from ... abit detail about your case from the time you met and how you got to interview etc with filled timeline wd help a lot of people in future here. MOst of the people try to match their own timeline with people who has already passed. I wd really appreciate that from your end. Thanks a lot.

I'll be going to my initial interview in a month and wanted to ask your opnion.

I also don't have a lease agreement with both of our names. The lease is only in my name (I'm the beneficiary).

I have proof of rent being paid from our joint check account and I also have all bills (eletric, tv, etc) with both of our names on it.

I can't add my wife's name to the lease, since it was inittaily done this way and she had credit problems in the past.

What do you suggest i do? is not having the lease realy a big deal even if you have bank and other bills together?

Stokes Interview Experience in San Francisco 2010

My wife (USC) and I have had our second AOS interview in San Francisco USCIS office. I wanted to write the details of the

interview before forgetting anything. I am sorry for the typos... I am writing really quickly and note I am not a native speaker.

I am aware that the stokes interview experiences are extremely important for those who are waiting for them :bonk:

We met and got married pretty quickly although we lived in different states. We could have moved in together approximately

after 3 months in CA. My EAD and advance parole document came from the mail pretty fast after my initial application.

We didn't use a lawyer as I had many friends who went the process without an attorney and finished it sucessfully.

We had been scheduled for a first interview in San Francisco in September 2010. The interview went bad due the lack of preparation

and partially, the IO was not a friendly person (No offence).

I would like to share my experience briefly from the first interview before detailing the stokes interview (the second one).

At the first interview, we waited for a while in the waiting room in San Francisco building.

We saw several different couples waiting with their lawyers. During the waiting time, we saw different

IO (immigration officers) coming in and out into the waiting room to pick the couples up. There was one precise IO that I really didn't want to have

for the interview. Actually, she got us :)) At this very moment, I knew this interview will end bad and it did. In 2-3 minutes to the interview,

she decided that we have to come back another time. I couldn't accuse her really as we had been newly moved in together back that time and even

my wife didn't have a driver licence from CA yet. She gave us back the documents and told us to wait a notice from the mail in a couple of months.

This was actually the notice for the stokes interview. We had the stokes interview notice within one months and it was scheduled for a month later.

For the second interview, we were prepared a little bit better. We had additional documents and pictures, let me detail them below. We went into the building

quite early around 7.30AM. We went to the same waiting room. While we were waiting, I saw the same IO again. I prayed we don't have her again. I am not a

religious person but It worked. We had a very pleasant and professional IO. She was asian origine and very young. She took us into some room with a

videotaping setting ready. Before starting the interview, she pressed RECORD and gave a description of the process. She didn't ask why we don't have a lawyer.

She made my wife to read the penalty of a fake marriage etc. She took me into some waiting room and she said she will be interviewing my wife alone.

I waited in a small room approximately 1 hour and 15 minutes with another guy having a similar stokes interview with a lawyer. Scared of being videotaped, we couldn't

talked to each other. It was really funny. Actually, it would help a lot both of us if we spoke a little bit.

After the waiting time, I saw my wife coming into the room. She had a very big smile on her face. At this point, I was not nervous anymore. The IO took me into

the same room and said she is gonna ask me a bunch of questions. She started to ask me around 100-150 questions as usual. You would only know them if you

really lived together as a couple. So, some of them were really detail oriented. For example, "where was your wife when you woke up on Saturday morning?"

After the inital questions about the location where we live and our parents etc. I recall some specific questions like "when did you have sex last time?", "Birth control",

"Plans about having a family?". She was also looking for details that you would explain and she could double check from your wife.

During saturday, we went to some remote place with a friend together. Although I remember the timeline in general, I don't remember many details such as:

"Who woke up first on Saturday?"

"Where was your spouse when you woke up?"

"What was she doing when you woke up?"

We have a 1 bedroom apartment and everything is very close to each other :)) so, I explained I can see her pretty much from anywhere in the apartment and I don't remember those details. She told me to explain what we did over the week-end beginning on Saturday. As I mentioned above, we went to shop with a friend. I have the impression this part of the interview went good as it was obvious that we went somewhere. After the interview, I discussed the questions/answers with my wife about the trip on Saturday.

For example, she couldn't remember the details of the first shop we went into and I couldn't remember the place we ate together. I would advise you to try to remember everything about what you do in the previous days before the interview. She asked us if we bought anything. We did not buy anything, but our friend did. So, we could remember some specific details although there were mismatches. I don't thing she expected us to remember every single detail.

More than two hours into the interview, the IO told me to go back to the waiting room and she restarted with my wife. I guess they went over the mismatches. After that she came back and asked me some additional questions. She also took the new pictures and other documents. The IO was not happy with the fact that we don't have too much things common property. She asked why I didn't transfer all of my money to the joing account and I still keep a separate account. The IO said something like, we didn't have too much really in the file and she wanted to support the case. I am not sure I understood her correctly, but it was obvious that she was running out of time to wrap up the interview.

After few minutes, she did bring my wife back with my passport and driver licences and she said we are done here and we can leave. Of course, I wanted to know the decision. I asked her is it good or bad? and what is going to happen now? She said she has to check with her supervisor and they will mail me the decision within two months. She was smiling when I insisted. I don't know what this means. I also noticed she left the I-94 in my passport. I am not sure it is a good or bad sign as the previous postings about this are pretty much inconsistent for keeping or taking the I-94.

To sum up, I don't thing an attorney would help in this or similar stokes interview cases. When we are getting back and forth into the waiting room, we met with another stokes interview couple with an attorney. I don't think their interview was better that ours as they didn't do anything over the weekend and they have a lot of mismatches about the details. I could hear them answering the questions but their attorney was not speaking at all. After the interview, we learned some unknown number called my wife's mom but she missed the call. Probably, the IO wanted to double check if she knew we were married. The parents of my wife were not present in the ceremony. I would advise also to go over the details of your meeting, decision for the marriage, and the timeline in general. As it is sometime ago before the interview, it is not easy to remember it.

Now, I would like to know what you guys think about our experience? Am I adjusting my status or the case is still open?

I would like to share my experience briefly from the first interview before detailing the stokes interview (the second one).

At the first interview, we waited for a while in the waiting room in San Francisco building.

We saw several different couples waiting with their lawyers. During the waiting time, we saw different

IO (immigration officers) coming in and out into the waiting room to pick the couples up. There was one precise IO that I really didn't want to have

for the interview. Actually, she got us :)) At this very moment, I knew this interview will end bad and it did. In 2-3 minutes to the interview,

she decided that we have to come back another time. I couldn't accuse her really as we had been newly moved in together back that time and even

my wife didn't have a driver licence from CA yet. She gave us back the documents and told us to wait a notice from the mail in a couple of months.

This was actually the notice for the stokes interview. We had the stokes interview notice within one months and it was scheduled for a month later.

For the second interview, we were prepared a little bit better. We had additional documents and pictures, let me detail them below. We went into the building

quite early around 7.30AM. We went to the same waiting room. While we were waiting, I saw the same IO again. I prayed we don't have her again. I am not a

religious person but It worked. We had a very pleasant and professional IO. She was asian origine and very young. She took us into some room with a

videotaping setting ready. Before starting the interview, she pressed RECORD and gave a description of the process. She didn't ask why we don't have a lawyer.

She made my wife to read the penalty of a fake marriage etc. She took me into some waiting room and she said she will be interviewing my wife alone.

I waited in a small room approximately 1 hour and 15 minutes with another guy having a similar stokes interview with a lawyer. Scared of being videotaped, we couldn't

talked to each other. It was really funny. Actually, it would help a lot both of us if we spoke a little bit.

After the waiting time, I saw my wife coming into the room. She had a very big smile on her face. At this point, I was not nervous anymore. The IO took me into

the same room and said she is gonna ask me a bunch of questions. She started to ask me around 100-150 questions as usual. You would only know them if you

really lived together as a couple. So, some of them were really detail oriented. For example, "where was your wife when you woke up on Saturday morning?"

After the inital questions about the location where we live and our parents etc. I recall some specific questions like "when did you have sex last time?", "Birth control",

"Plans about having a family?". She was also looking for details that you would explain and she could double check from your wife.

During saturday, we went to some remote place with a friend together. Although I remember the timeline in general, I don't remember many details such as:

"Who woke up first on Saturday?"

"Where was your spouse when you woke up?"

"What was she doing when you woke up?"

We have a 1 bedroom apartment and everything is very close to each other :)) so, I explained I can see her pretty much from anywhere in the apartment and I don't remember those details. She told me to explain what we did over the week-end beginning on Saturday. As I mentioned above, we went to shop with a friend. I have the impression this part of the interview went good as it was obvious that we went somewhere. After the interview, I discussed the questions/answers with my wife about the trip on Saturday.

For example, she couldn't remember the details of the first shop we went into and I couldn't remember the place we ate together. I would advise you to try to remember everything about what you do in the previous days before the interview. She asked us if we bought anything. We did not buy anything, but our friend did. So, we could remember some specific details although there were mismatches. I don't thing she expected us to remember every single detail.

More than two hours into the interview, the IO told me to go back to the waiting room and she restarted with my wife. I guess they went over the mismatches. After that she came back and asked me some additional questions. She also took the new pictures and other documents. The IO was not happy with the fact that we don't have too much things common property. She asked why I didn't transfer all of my money to the joing account and I still keep a separate account. The IO said something like, we didn't have too much really in the file and she wanted to support the case. I am not sure I understood her correctly, but it was obvious that she was running out of time to wrap up the interview.

After few minutes, she did bring my wife back with my passport and driver licences and she said we are done here and we can leave. Of course, I wanted to know the decision. I asked her is it good or bad? and what is going to happen now? She said she has to check with her supervisor and they will mail me the decision within two months. She was smiling when I insisted. I don't know what this means. I also noticed she left the I-94 in my passport. I am not sure it is a good or bad sign as the previous postings about this are pretty much inconsistent for keeping or taking the I-94.

To sum up, I don't thing an attorney would help in this or similar stokes interview cases. When we are getting back and forth into the waiting room, we met with another stokes interview couple with an attorney. I don't think their interview was better that ours as they didn't do anything over the weekend and they have a lot of mismatches about the details. I could hear them answering the questions but their attorney was not speaking at all. After the interview, we learned some unknown number called my wife's mom but she missed the call. Probably, the IO wanted to double check if she knew we were married. The parents of my wife were not present in the ceremony. I would advise also to go over the details of your meeting, decision for the marriage, and the timeline in general. As it is sometime ago before the interview, it is not easy to remember it.

Now, I would like to know what you guys think about our experience? Am I adjusting my status or the case is still open?

Day40 - 11/05/2012 - Interview letter for Dec 4 date - The BIG Day !

Day70 - 12/04/2012 - Interview done. Pray to GOD!

Day95 - 12/28/2012 - Letter for 2nd Interview in Feb

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
