Regarding:

What evidence is needed at Adjustment of Status interview?

From:

http://www.visajourney.com/faq/k1k2visa-aos.html#6.11.2

"sworn statements from at least two persons, attesting to the length of time petitioner and beneficiary have been residing together in Marital Union."

We have our second AOS meeting (we failed the first due to a lack of documentation and expect to be put through a "stokes" interview) next month.

I hope to type up the following statements and getting them signed in the presence of a Notary:

* My Former Housemate:

I have known Sam and Diane the entire time they dated and am aware they got married in October and are now residing together in a Marital Union.

I also knew Sam and Diane for the 6 years they dated (prior to marrying) and can attest they were in a committed relationship the entire time they dated.

* My Dad:

I am aware that Sam and Diane were married in October and are now residing together in Marital Union.

What do you think? As you can see, I am pretty bad at this. Does anyone have any lengthier examples of "sworn statements" I can take ideas from?

Thanks!

Sam (The American)

I would suggest that you provide more facts. Your current statements are rather conclusory; provide some facts. Also, you need to clearly state out name and address of the person making the statement.

I suggest the following:

1. Full name, address, and phone number of person making the statement

2. Describe the person's relationship to you and your spouse

3. Give some specifc facts, e.g. they attended your wedding, they know you were going out before getting married, how happy you were about the marriage, etc -- facts SHOWING marital union - compared to just stating conclusory that you and your spouse live in a marital union.

You can't type up the statements and have the people sign them -- they should really make a statement in their own words and do it themselves, IMHO.

In the guides, I came across a few affidavits of support for the removal of conditions process but I think they could serve you as examples of affidavits for the AOS process as well.

We submitted 3 letters from friends and family, they are very simple to write. I will give you one example:

My best-friend wrote something like this:

"I have known ........ (me) for about 6 years, we met in high school and graduated together. We were already friends when ... (me) met ... (her), they dated for about 4 years and then got married at ...., a wedding which I attended. I have spent several vacations with them, I have gone out to dinner with them and family in several occasions. ........ (Have them describe - not in details - one or two occasions where they spent time with you and your spouse, have them write about parties at your house or get togethers, etc). Then at the end of the letter, he wrote something like: "I have no doubt that they have an ongoing relationship and that they have a stable and loving marriage."

Anything along those lines - my interviewer officer spent less than 5 seconds in each letter and before I knew it, they were in our files.

Here is what my husband's cousin did for us:

"June 29, 2007

To whom it may concern,

I am the director of xxxx and the cousin of ________. I have known (hubby name) all my life and I have known (my name) for 10 years, indeed they met for the first time on my front porch.

They met here in ____ and started dating right away, (my name)was here visiting my family for the summer. When my namereturned to France to finish school, they continued their courtship via email, phone calls and letters. As their friends and family, we were thrilled; they seemed perfect for each other.

We have been encouraging them to get married for 2 years, they have said they want to but my namehad wanted to be self-sufficient and be able to come to the marriage as a full partner. I am very happy they have decided to stop waiting, got married and joined our family.

If you require anything else I could provide to support the fact that this is a couple who truly love each other and are married, please do not hesitate to call on me.

Very Sincerely,

Her name

Executive Director

Address of where she works

Phone numbers "

I submitted a sworn statement with our I-129F and it was a whole page - basically a letter. It was a bit lovey dovey but hey, it's true (L) . I'm sure that is different than what is needed for AOS.

I like the example that says that the person writing the letter attended the wedding.

11/2004 - Met in Brazil

09/2006 - Apply for K1

03/2007 - K1 approved

04/2007 - Apply for AOS & EAD

07/2007 - EAD approved

01/2008 - Conditional Residency approved

11/2009 - Apply to remove conditions

02/2010 - Permanent Residency approved

11/2010 - Apply for Citizenship

03/2011 - Citizenship approved

07/2011 - Moved back to Brazil

You can't type up the statements and have the people sign them -- they should really make a statement in their own words and do it themselves, IMHO.

Yes, and I would ask them to include some things they observed about your relationship or what they know about it. Indications they've been to your home and spent time with the two of you together would be good. The original letters sound like the kind of things strangers might write if you paid them to lie for you.

Facts are cheap...knowing how to use them is precious...
Understanding the big picture is priceless. Anonymous
