I looked at the Consulate website and it states a nonresident must marry in the Netherlands to do a DCF. I talked to somebody at the Consulate and they confirmed that. She said if I married in the US I'll have to do a K-3.

I've read in other places that the marriage can take place anywhere. Just wanted to throw my experience out there.

I've never heard of that being a requirement for Amsterdam In fact I know of one couple who married in the US, have filed the I-130 in the Netherlands and are waiting on the visa interview right now.

Yep, Meauxna....

we filed an I-130 on 21 February at 3 pm. :D We married in the US on 2 January 2006 while my husband was here on the VWP; he returned to the Netherlands on 9 January 2006 (before his I-94 date).

The average wait time quoted to us was 8 weeks from filing; we thought it might go through quicker, but there was a longer-than-average delay between them receiving packet #3 and the interview date. My husband's medical was last week and his interview is this Thursday.

We both posted stories about our experience on USA Dutch. The one thing I would point out is that the consulate's website says that it processes DCFs for "recent marriages" -- though that is open to interpretation.

The DCF must be a straightforward case or it may get kicked back to go the in-US route -- eg no criminal record, adequate financial support, etc.

Odd.... unless that is a very recent policy change you did not get correct information and I have had one SWAMBO who gave me incorrect information on another matter.

I'd urge you to call back and see if you can speak to the Vice Consul. I'd be very polite and ask if there has been a recent policy change on this point and if so, when it took effect. The informal policy has always been that a couple can marry in the US.

2) Is your spouse in the US or elsewhere?

3) If in the US what is their current immigration status (if on the VWP, the I-94 date)?

Thanks for the great info, all.

I just wanted to know if anybody had done it very recently. I'll call the Consulate back as Amy suggested. I forget the name of who I talked to, and it was a bad connection, but she sounded Southern. I asked her specifically if we were to marry in the US, and she said the Consulate won't do a DCF.

1) Are you married yet?

1) I'm not married yet. We were planning to marry in Holland after summer. But we got caught in some legal blackhole. She was actually born in Pakistan and came to Holland when she was less than a year old. When she called up the Netherlands Embassy in Pakistan to get a legalised birth certificate, they told her they had temporarily closed that service (they said they're trying to figure out a way to deal with all the fake paperwork that comes from Pakistan). And the guy in Den Haag says she can't marry without one. So here we are.

2) She's still in Holland. She'll come to the US to marry on a K-1 visa if I find out we can't do a DCF.

And I'll check out the stories in USADutch. Maybe I'll be able to do it after all.

American citizens may file I-130 immigrant visa petitions for their immediate relatives (spouse, unmarried minor children, parents*).

The Consulate can accept and approve I-130 petitions from

Americans who are residents of the Netherlands

or

who were recently married in the Netherlands to a legal resident, Dutch national or other, of the Netherlands.
