I am the USC, do I need to send a copy of my passport in with my husbands AOS & EAD application?

I think just if you want to use it as proof of your identity.

On the VJ Guides HERE it doesn't say anything. I included a copy of Rob's biographical passport page and birth-cert, because I thought they needed proof of his citizenship, but it seems I didn't need to.

So, the answer to your question is No, I would imagine

You don't HAVE to if yo uare sending in a copy of your bith certificate, but we did both, bith certificate and a passport copy. It is used as both proof of identity and citizenship. So I think you SHOULD send it.

I believe somewhere in the fine print of the I-864 it is written that you need to send either a copy of the passport or of your birth ceritificate to prove you are a citizen and therefore eligible to submit the affadavit of support for your spouse. I of course missed this and am waiting for the RFE

Yes, the sponsor on the I-864 must submit proof of U.S. citizenship, i.e. passport or birth certificate.

But the wording is unclear:

"If you are a joint sponsor or the relative of an

employment-based immigrant requiring an affidavit of

support, proof of your citizenship status."

I didn't send my USC husband's passport copy or any other proof of his citizenship with my AOS/EAD applications. It's not needed.

But I think it might be different if the USC wasn't born in the US.

I didn't send in any proof of my husband's citizenship.. its only required if you are a co-sponsor or if its an employment based immigrant.. Most of us are basing it on marriage so we aren't included in this category

Question here, isn't citizenship already established during the petition phase? Wouldn't it be very unwise of the USCIS to wait until the AOS phase to verify the USC's citizenship??

That's just my take on it. We did not send in any of my husband's (USC) BC or passport pages, since we already had during the petition part.

That's just my opinion but I guess we'll see what happens.

A birth certificate or a passport will do, either is an option.
