I am pissed that people get work visas quickly and LIE about it. I know several people who do it so that they can freely cross the border whenever they want. We could have done it that way too, but we wanted to do it the RIGHT way. And what does that get us? Over 5 months of waiting for an interview... so far. They treat the people who do it legally like worthless #######, and they don't blink twice at the illegal ones. Bunch of bullshit.

In respnse to that here! here! I know one couple that married down there then filed for AOS didn't have to go through what we are goin through and she was not made to come back to Canada she is allowed to stay in the US and go through the whole process there,and they have gone through all the paper work sent everything off approved in record time,and was able to stay with her hubby! To me that is so not fair for those of us who ARE doing it the right way but have to suffer the waiting, I almost feel like sneaking back into the states stay with my SO until it is nessessary sneak back over here get it done and then go back legally,, man you have no idea how temping that idea is, trouble is with my luck I'd get caught and be banned for ever, our life time of happiness isn't worth that risk so guess i'll just have to suck it up!!!!!! Just like the everyone else on here!!!! Ho Hum!! God I hate this!!!!

Thank you so much for being as mad as me at people who do things illegally and get away with it!!! I am sick of it!!

Did you know that I can set up my own little company and write work visas???

These visas take......... get this........ one month to receive. :blink:

Had a free consult with an immigration attorney in DC!! Thats what she told us to day--me simply stay and AOS!! Many do it that way!! Not illegal if you came into he usa and had not planned on staying!! But I'm sure many abuse it.

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

yeah it seems that that option (get married and AOS) is designed to be abused. The people that use it are either completely impetuous or lying. "nope never planned on getting married this week" Best case scenario people are being rewarded for not thinking about what they are doing and planning their actions.

4/1/04 no word from NE contacted senators office, app found

NOA1 4/13/04

Gave up on ridiculously long US process-started Canadian

12/4/04 submitted app

LSS app returned because of missed signatures, lost in transit, resubmitted in June

9/28/05 landed, yippie

10/4/05 fly back to US to "finish up Master's" lose mind and switch to PhD

Damn it back to the US process

3/something/2005 finally get NOA2, no idea why it took so long

4/15/07 get case approval from NVC

8/9/07 Montreal here we come

10/14/07 hubby activated his visa

Abuse is correct. They get rewarded while we get f&cked.

By the time our interview comes around, maybe it'll be an IR instead of CR !!! I'll bet it'll be at the 1 year 11 month day. That way they can screw us out of more money in a few years.

I thought Canada was a Friendly Country.

The way I see it, people who move first and apply later - well it just doesn't bother me.

Apparently the USCIS isn't that concerned about it or they would send them all packing. We considered just moving there to see if we really wanted to move and then adjusting there - but decided we didn't want the hassle if they said it was a no-go.

It's really pretty friendly that they let so many people do it don't you think?

I'm not annoyed by others who do things differently... well unless they're totally blatant about it like, "I don't care, I'm just going to do it this way even though I'm totally lying at the POE." I'm not annoyed by EWIs either as their situation is completely different and I sure as hell wouldn't trade places with them ever.

What I am annoyed at is USCIS, DHS and the DoS and whoever that decided that family-based visas take a backseat to other visas that take a shorter amount of time. Everything is so damn backlogged, all the fees went up and the process itself is just... someone said it recently... like paper cut torture, slow, painful, archaic, inefficient -- come on ####### is up with how the NVC processes petitions for CR-1/IR-1? Ridiculous!

I absolutely agree with you misa, I have never seen a system where you send something and they send something back then you send something and they send something back - what's up with that? I have pondered this and decided that at some point they were inundated with applications and someone said - hey, how can we slow these down? So they came up with this exchange plan and it stuck!

Also, I still don't understand how we can only have 1 consulate for CR-1/IR-1 visas - it's almost 4000 kms to Montreal from Calgary - hellloooo! That's completely aside from the amount of time we have to wait to actually GET an interview.

hear hear on all of that, I hate the system that has a loophole like that for people that can afford to not work for a few months. Yet another case where the US gov't makes it clear that while all are equal, some are more equal.

the interview thing really pisses me off. it was a total joke. there was no reason for us to go to Montreal for that lame of an interview. If the US really wanted to speed up processing, they would start waiving spouse visa interviews unless there were glaring flags suggesting the marriage is fraudlent. And have all applicants fill out all forms and pay all fees at the beginning of the process, like Canada does.

For the most part I find it absolutely hilarious that all these fees have to be paid in sections - sure, it helps to save for the next round, but then you have to remember to pay this check at this time for this form at this place...

I feel for you guys and all these ridiculous loopholes. It totally feels sometimes like we've been punished for doing things the proper legal way. :(

From what I've seen with interviews here where all paperwork is in order, etc., they've already made up their minds before you even get to the interview. Everything they ask is just a formality. I understand needing to verify identities of whether you're actually the person in the petitions, etc. but seriously, can't they just do that step (checking your passport with your file and taking your index print) at any consulate?

it really is a formality. the guy hadn't had our file long enough to really study it. and half of the 3 minute interview was spent discussing Yellowstone archaeology and microbiology. Other than "How did you meet" not a single question addressed our relationship. the guy clearly knew he was going to give the hubby his visa before we went in. Waste of everyone involved's time.

Heh, pretty much the same here except replace "yellowstone and microbiology" with "cooking websites". My CO did ask when we got married (looked on the file when I answered) and few other standard questions but I'm convinced he already had his mind made up before even seeing us. Although I will say that I do hope my upcoming AOS interview next week is going to be as much of a rubber-stamp deal as my K3 was.
