EAD and AP for DCF

Hey guys!

You probably read this previously somewhere - though I couldn't find it yet :blink: - I wanted to know WHEN to file for an Advance Parole!

I know there's a lot to go through, I just received Pack 3, but still, I'm sure it would feel a lot less worried if I had the permission to travel back and forth, since the Condicional on my Permanet Residency is suppose to last for 2 years...

Anyway, do you guys know what to do regarding that? When should I file for an AP and even for the EAD? I saw on the timelines that the average days for the EAD is 78 days... but I have no clue when to file!

Any coment is welcome!!

  • 10-06-04 - We met online
  • 04-24-05 - I traveled to the US
  • 05-14-05 - We met in person
  • 05-25-06 - I came back to Brazil
  • 09-25-06 - He moved to Brazil
  • 02-13-07 - He proposed!!!
  • 07-04-07 - We signed papers on the Civil Registration Office and are legally married!
  • 07-09-07 - I changed my name on a new passport

  • 08-14-07 - Received Pack 3
  • 09-20-07 - Appointment at the Doctor in Curitiba
  • 09-24-07 - Tom went back to the US - his student visa expired :-(
  • 10-16-07 - Sent DS-2001 to the Consulate in Rio
  • 10-19-07 - Tracking says Packet 3 was received by the Consulate in Rio
  • 10-20-07 - Got Tom's I-864 and supporting documents through the mail
  • 11-12-07 - Got Packet 4!!!!! Interview on November 21st!
  • 11-21-07 - Got the Visa!!!!! Easier than a walk in the park!
  • 12-30-07 - GRU - SFO
  • 12-31-07 - Got to SFO and Tom was there waiting!
  • 02-12-08 - Welcome Letter came - about 3, actually!!
  • 02-16-08 - Green Card in hands!!!!
  • 12-03-08 - Found out we are pregnant!!!!!
  • 03-26-09 - It's a Girl!
  • 07-28-09 - Berlin Cecilia - 6lb7oz, 19in
  • 10-05-09 - Mail I-751 to CSC
  • 10-14-09 - NOA 1 - Free to work and travel!!
  • 10-19-09 - NOA 2 - Biometrics Schedule
  • 11-10-09 - Biometrics Appointment

Mila, neither an EAD or AP is required when you do DCF, as it results in a Green Card after entry. Permanent Residents are allowed to leave the country without advance parole, and work authorisation is automatic with the Green Card so no need for an EAD. Even with the Conditional Green Card, you may still enter/depart the US as if you had the 10-year GC (although there are restrictions on the amount of time ANY GC-holder may remain outside of the US without being deemed to have abandoned the GC).

Gotta love DCF! :D

Will I have a I-864 fee bill? I see everybody talking about it but I have no idea how to proceed!

I see lots of info about the K-1 and keep thinking if I'm missing anything on my process, you know?

I mean, everything is happening so quickly I keep thinking that's too good to be true!! :lol:

As always, any info is very welcome!!!

No, there won't be any fee bills. The I-864(s) are taken to the interview and the visa fee is paid on the day of the interview.

DCF is sooo much better than having to go through a US service center, so it's not too good to be true. :)

US Immigration Timeline

-------------------------

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly
