This is an unromantic subject if there ever was one. :( But it needs to be discussed. I'm going to marry a woman I met online who lives in Vietnam. Every single person I know, be they friends or family, has begged me to get a prenup. One good friend of mine personally know a number guys who were taken to the cleaners by their foreign brides after a few years because they had no prenup.

Do I believe my fiancee is capable of that? Do I believe that is her plan? No.

But I work in a business that could result in my making a damn fine living and if that is the case, I need to protect myself.

Please, no lectures from women here calling me a creep. I'm not. I simply have to be realistic.

I don't think that makes you a creep so long as the two of you have discussed it and she is okay with it. Its really only something that concerns the both of you.

I would google it, see what you come up with.

The real problem is that apparently these things are useless unless they are signed a good month in advance of the wedding. But unfortunately for us, we had planned on flying fron Saigon to Hawaii as soon as she got her visa so that we could marry and honeymoon there.

So now what? Doing it after the marriage is no good. We do not want to change our plans because it would cost us too much money.

Advice?

If your plans are written in stone and you're not willing to change them, then I guess a pre-nup is out of the question. The way I see it, if a pre-nup has to be signed a month prior to getting married, then you either change your plans or forego the pre-nup.

A consultation with an attorney still isn't such a bad idea. There may be other options which we are not aware of.

We have a pre-nup...was done by lawyers.....mine in Canada and his in the US.....we signed the thing about 2 days before our wedding...neither laywer stated it was not valid. I would double check that.

The Pre-nup protects BOTH SPOUSES not just one

I have to wonder if there is a lawyer in Saigon who would be knowledgable enough about US law for us to have seperate attorneys. One can buy a simple preunp online for $22 from a number of websites and USA Today has talked about them. They are legit.

But the lawyers are still needed and will try and charge an arm and a leg. :( How I hate what lawyers have done to this country.

I have been thinking alot about this lately. Mainly because he is about to go to court for his divorce and his ex is going for his military pension, the house he bought last year for us and our savings since we got together almost 3 years ago.....unfortunately it is all to be regarded as their marital property...although he did give her half of the savings they had when she left plus $7000 to get her to finish the divorce. They had no kids or property.

So I am kind of thinking about this pre nup thing...if anything should go bad between us...I suppose I worry that he has this in the back of his mind, about having to go thro all this again. I would be more than happy to sign an agreement that is fair for both of us. Personally I would just want to return to Uk and have enough help to set up a home again.

Hmmmm...I think I will bring this up tonight and find and his view on it....

We´ll get one depending on the law in Puerto Rico.

In Brasil if you don´t get a prenup it means you are gonna share anything you acquired after the marriage, but nothing before.

If in PR the rule is the same, we won´t need one, but if it isn´t, I want us to get a prenup stating that all we make after the marriage is to be shared, but not what we had before (although we have nothing) nor what we get through inheritance (which is why I want it to be this way, so we don´t involve our families).

That will do it. However, I recommend you use an actual attorney.

I thought both parties *had* to use separate attornies to make the prenup valid?

Also, if Matt doesn't have any current assets to protect, is there any use in doing this? Usually, income generated during the marriage would not be protected? Of course there's ongoing residuals with authoring, so I think learning more about pre-nups is the first step.

According to everything that I have read, a prenup can allow for you to keep your own assets (what you brought into the marriage) if there is a divorce. Example: Husband sells a screenplay for 2 million dollars. Wife says I want a divorce and gimme half. Prenup says you keep your own income. Husband is protected and keeps his money.

A prenup can also say NO alimony.
