No more K1 and K3 at the same time?

I just called USCIS to find out the status on my case, and the representative asked me "did you file I-129F and I-130 at the same time, because if you did, just wanted to let you know we won't be allowing that anymore".

So it sounds like you won't be able to file both fiance and marriage petitions at the same time...at least not at Vermont. He didn't give me a date...he was rushing me off the phone.

Just wanted to share....

June 8th - I-129F mailed to VSC

June 13th - NOA1

November 9th - NOA2!!!

January 10th - APPROVED!

January 24 - Pick up visa

January 31 - Honey arrives in US!

February 28- Court marriage

May 2- NOA1 for I-485 and EAD

May 31- Biometrics

June 2- TOUCHED

Sept 2008 - Perm resident

12/7/12. File n-400 at Dallas Lockbox

How can you be married and engaged at the same time?

K-3 uses I-130 and I-129F, but I-130 is usually filed before I-129F. But by filing the i-129F with the I-130 doesn't mean you are applying for a fiancee visa, only taking the K-3 option of the CR-1/IR-1 path.

Well, for a fiance, they will not accept an I-130 and I-129F at the same time because an I-130 is not needed for a fiance visa or for adjusting status after using the visa and marrying.

Also, if you called USCIS, you didn't talk to somebody at the Vermont Service Center and, they don't call it the misinformation line for nothin.

Facts are cheap...knowing how to use them is precious...

Actually, I did talk to someone at the Vermont Service Center...I do know how to get transferred there from calling the USCIS number. And I've seen on here that some people have concurrently filed 130 and 129F to see which one is faster. This is what I'm referring to.

No, thats not the case, K-3 requires both forms.

Then your reference is in error. Married people who file the I-130 and I-129F are not filing for K1 and K3. They are filing for K3.

Filing the I-130 alone will result in a CR or IR visa, not a K. I-130 and I-129F can still be filed together, now in the same envelope and directly to the appropriate service center but what has changed is that when they do so, only the I-129F will be forwarded to NVC, unless they specifically request Consular service on the I-130 at the time of filing.

pushbrk's information is correct.

I think you have your terms confused. The I 129f is the main USCIS form used for (fiance/e) K1 petitions.

It is also used with the USCIS form I 130 for a (spousal) K3 petition.

You cannot apply for both a K1 (fiance) and a K3 (spousal) visa at the same time. Aside from being institutionally (USCIS) impossible, its also non sensical.
