Hello,

My fiancé wants to change his last name to his grandma’s last name. All of his K1 documents are under his current last name of course. When we will get married, can we both switch to his grandma’s last name and will there be any problems when we will fill out AOS papers? Anything we should know? Or we should wait already when he will apply for citizenship?

Upon marriage, isn't there an opportunity to legally change the name of either the husband or wife?

I'm guess its restricted to either of the last names or hyphenating, but that may vary depending on the state you plan to get married in.

In NY

but it's not my last name and he'll change it to his grandma's name, can they ask where did he adopt this last name from?

i am afraid it'll give us problems with the AOS process, so just wanted to make sure.

In general, he would need a judge to order the change of name. Probably depends on your state. I think that you are in New York, in which case you need to file a Petition for Change of Name.

You would presumably file this with the Clerk of your local NY Civil Court.

Don't bother changing your own name when you get married, since you will need to do this as well.

Yes. Pay a fee for a replacement one with the new name.

Isn't what you are referring to here when you wish to change your name outside of a marriage event? If you look at NY marriage application instructions, it allows either part to change there surname (4 rules as to what is an allowable change).

A grandmother's surname does not meet any of these 4 tests. (It must be one of the couple's surnames, former surnames, or a hyphenated combination thereof.)
