Ok I hope in asking in the right place. I posted about our K3 denial in panama consulate. Ok after talking to lawyers and they telling me many different things i need some help on decisions. One tells me he would reopen and rebut the denied K3 3000.00 dollars. The next guy Say's Your K3 petition expires on Aug 18 so they will not look at it until i get a notice and send evidence to reopen. He said he would take the case for 5000.00, well the next one said just go through with the CR1 because you I-130 are approved and re interview for the CR1 with more evidence to prove your case. I don't know exactly what to do it's driving me insane with all the different advice from lawyers. I just want to see what people here thought.:wacko::wacko:

Did they tell you why they denied the K3? Did she go to the interview & they denied her there? Or did they ask for more evidence?

I think no matter what, you have to have A LOT of evidence, given you guys haven't even been together for a year... and got married within 2 months of meeting.

Ken,

You should try to PM this member from VJ: OskaryAndrea. She had her K3 visa denied earlier this year and consulted with a lawyer on what needed to be done. She may have some tips on what you can do.

For denied cases, they should put there the reason for the denial and based on the reasons, if you think there are grounds that you can prove that they are wrong then you can file for reconsideration and present your evidences.

But since you also have an I-130 approved petition, you may opt to just pursue with the I-130 and go for the CR/IR visa. You will also be saving thousands of dollars (for payment for the lawyers)... Since you know the reasons for the K-3, you may have to present evidences with regards to this problem at your CR/IR visa interview. (just my opinion) Good Luck! Hope everything will turn up well for you.

When I did the K3 I considered the CR as a backup.

Once the petition is sent back to the USCIS you are in for a steep uphill climb and may not reach the top ever.

Find out why you were denied the K3.

Senators or congressmen can usually find out why if you can't for sure.

If it's lack of a bonafide relationship> Fly and accumulate more evidence.

Also will help to attend the interview.

If it's something you can't correct like medical, drug use, criminal record etc.

It's lawyer time!

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

!! ALL PAU!

No they didn't give her any papers just returned her passport and told her they are sending the petition back. But from what i understand is when the petition for the K3 expires they only send notice of intent to revoke and then it's a long period from the time you answer to get a discussion the one lawyer said they can drag it out for over a year.
