My fiancee was here in USA on k-1 visa, we didnt get married and she came back home. She didnt overstay her visa.I want her to come back here and I dont want to wait 2 years for the next petition. What is the best waiver for me? Please help us.

Thanks

Camil

This is not a 212 or 601 waiver situation. You need an IMBRA waiver because you had a " K-1 visa petition approved within two years prior to the filing of this petition, you must apply for a waiver". The I-129F instructions explain "To request a waiver you must submit a written request with this petition accompanied by documentation of your claim to the waiver".

So start over by filing a new I-129F and include a written request (that's the waiver) and documentation with your I-129F petition to request a waiver of the filing requirements.
