Hi list,

I am planning getting married this month and I am trying to prepare the list of things I need to apply for I-130 petition. I noticed along with the marriage certificate one of the following need to be sent:

Evidence of a Bonifide Marriage

The USCIS now requires that when filing an I-130 for a spouse that you include evidence of a bonaifide marriage. They list examples of acceptable evidence as:

1. Documentation showing joint ownership or property; or

2. A lease showing joint tenancy of a common residence; or

3. Documentation showing co-mingling of financialresources; or

4. Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together; or

5. Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and detailsexplaining how the person acquired his or herknowledge of your marriage); or

6. Any other relevant documentation to establish that thereis an ongoing marital union.

Is it ok if I get 5. affidavits from mother and brother?

I have previously applied for I-129F but without rebutting that I am marrying my Fiancee, any advice in this case?

Did you find out the reason why the embassy did not issue your fiancee the visa?

I would be concerned that you may pursue the K-3 or IR1/CR1 process only to be denied for the same reason...

Perhaps they haven't updated their timeline, but it appears to me that they didn't finish the K1 process but are getting married instead. If that's the case, they need to cancel the I-129f for the K1 process. If they did finish it and were denied the K1 visa, you're right that they will likely run into the same problems with the K3 visa.

US Immigration Timeline

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

Hi list,

Our K1 application has be sent back to NVC

Documents to be submitted:

Documents submitted by you are unable to establish that a credible relationship exists

between yourself and petioner. The fiance visa petition is valid for four months from the

date of its approval. Your petion was approved on December 27 2006, and since then, more than

four months have elapsed. Because the consular officer was not convinced with the relationships

between yourself and petitioner, the petition has not been validated. We have returned the

petition to the National Visa Center. Hence forth no further action will be taken by the post

on your case.

I am planning to get married and apply for CR1 and here are my questions:

I have already applied for I-129F, they already have all our information.

Do I have to start the application as a fresh?.

Did anyone went throught this?.
