Hey yall;

In one of myprevious posts I had mentioned that my SO's father had filed an I-130 petition for him that was approved in 2002. We had planned on getting married in October and have me petition for him as my spouse because the petition that his father filed usually takes about 10 years for a visa number to become available.

Well, I spoke with him today and he told me his father called and told him that the AOS bill was sent to him and he planned to mail it off to the NVC yesterday. Now we have to abandon the plans we have and join the waiting game for the NVC to proceed with the previously filed petition. No sense in re-inventing the wheel and spend money un-necessarily.

I would want him here ASAP, but because we had decided to pursue the CR-1/IR-1 route which I see takes about a year to be completed, we might as well wait for this to be completed. I don't know if I am setting myself up for a loooonnnggg wait, but I feel like my hands are tied.

I don't know if what we were planning to do will negatively affect the process either way.

My questions are?????

How soon after this should he expect the DS-230 and other request for document processing as NVC is now scheduling interviews for Kingston.?

How soon after the AOS bill is generated would one expect to get an appointment for visa interview?

Do you guys think that if I try calling NVC, maybe someone can tell me if I should just go ahead and file the K-1 or CR-1/IR-1.

I hope you guys can help me sort this out. I am so confused and right now I am feeling fraustrated, as I can't figure out the right thing to do. :help::help::help::help::help:

I was just speaking with my mom about this and she told me that if you should get married, it will "kill" his father's petition and you will have to start the process all over again. The petition is affected because by getting married he is now technically in a different category than he was originally petitioned for.

It looks like the NVC is moving on the petition since they have sent the AOS bill. With the new process, I am not sure how long it will take for him to get an interview, but I am sure it will be within months. If you can, hold off on the wedding, sweetie.

Hey Tam;

Thanks for your response. I feel much better that you attempted to help me with my decision. We have decided to hold off until I can confirm with his father what the letter actually said. When he spoke with his father he was not specific but only said he has to send some affidavit and a $75 fee. I am assuming that the only affidavit that requires a fee is the AOS. I told Mike to ask his father for a hard copy so I can evaluate it for myself. With all the info that I have garnered from VJ, I think I can actually to a gestimate of where he is in the process. :wacko:

I was getting so excited about getting married and was already making plans to have a small ceremony with a few family members at my brother's house. I just found out that I have a nephew who is an Adventist Minister and had agreed to perform the marriage ceremony at his father's (my brother's) home. I had to call him last night and explain to him that that might not happen. :angry:

Well, the saying goes, every disappointment is for some good. I am just taking it in stride at this point. I was so looking forward the the experience of the journey and sharing it with my VJ family, but now I just have to keep lurking and enjoy your journey and be some type of support in your joyous occasions. :thumbs:

Claire I think your best bet is to call the NVC or USCIS and ask where they are for priority dates for that classification of visas. He priority date is sometime in 2002 but it's possible they're just now assigning visa numbers for priority dates in 1999. who knows

Once you find out where they are you can then make an informed decision of whether or not to wait. It might still be considerably faster to file for the CR1 or K1/K3 visas.

This is correct, however, I believes it also differs b/c the wife wouldn't be migrating w/his son b/c she is a USC. Claire I think you should hold off on getting married to your SO b/c it will complicate things. Since his father has paid the AOS fee bill tells us that a visa # is already available. When I starting this LDR with Mike, he told me about the petition filed by his father. When I got back from JA I called USCIS and gave them his case number. (I was clueless about the immigration process, even though I came here on a fiance visa in 1986). I was told that after the petition is approved it is sent to the NVC to vait for a number to become available and was told to call the NVC. When I called them in April, they gave me a case number. Not knowing what that meant, I started to research to find out about the best way of getting him here. That was when I found VJ and the wonderful people that provided support and advise and posts about their experience.

Now, last weekend I was told that the AOS fee bill was received by his father (USC). I went to the NVC site and found that the priority dates for September is Jan 2000. His petition was filed in Feb or March 2000. This is the reason why we have decided to hold off on our plans until we hear further from the NVC, because from somewhere on the VJ site I saw where when the AOS fee bill is paid, the DS-3032 (choice of agent form) is sent to the recipient and the the paper trail starts. (I will find the info and post it so that I can be more specific as to what I am referring to).

This is where the journey starts to look somewhat like the CR-1/IR-1. So by my estimates, the rest of the process would be about a year.

This site has been tremendously helpful and informative. I can find just about anything regarding immigration here. I just wish that people who petition for their relatives other than spouse/fiance would also post.

OK y'all;

I went back to the NVC site and re-read the visa bulletin and the priority date is the date that the petition was received (NOA-1) at the USCIS. Visa numbers will now available for priority dates up to Jan 1, 2000 in September 2007. My SO priority date is about Feb or March 2000. Maybe that is why the fee bill was sent because he might be getting a number soon (Oct/Nov).

I am so excited, I just can't hide it. I don't want to loose control but I think I like it!! Oh Yeah..

Yes this is correct, I tried to explain it but I know it's confusing. There is a forum that states bringing other family members besides fiances/spouses. I think it's in the regional forum. The process is pretty basic across the board. I know serveral ppl that have brought over siblings, parents, and children and the process was all the same like the CR-1 / IR-1 once a visa # was assigned. The only difference is the wait time. Also it should take another year for him to arrive. If his father and give gather all the necessary docs before hand it can be significantly less. Good luck!
